Why are hookers illegal, and pornstars not?

Either way, theyre exchanging their bodies for money.. is one legal and the other not simply because theres more paperwork with being a pornstar?

Robocop 07-30-2003 12:03 PM

erotica is legally protected free speech/art

michaelw 07-30-2003 12:04 PM

so youre saying
"Big Black Dicks in White Chicks" is art?

no, im saying your mother trading handjobs for hamburgers is illegal.

escorpio 07-30-2003 12:05 PM

The distinction walks a legal fine line and is nonexistant in the real world.

Evil1 07-30-2003 12:05 PM

Very simple, the gvt can tax porno sales, they can't really tax steet hookers.

A lot of things are illegal not for moral issues, but for monetary issues

So someone was to film themselves having sex with a hooker, who would have to sign a model release, would that make it legal?

No doubt they do, but at the same time, street hookers are illegal.

KRL 07-30-2003 12:22 PM

When you produce pornography you are paying someone to ACT eroticly so its covered legally.

The keyword being ACT. :Graucho

I thought prostituition was legal here, but solicitation is illegal (Vancouver). You can charge for it, but you can't offer somebody money to have sex with you?

Ah no, here it is:

'Communicating for the purpose of prostitution in a public place' became illegal in December, 1985. The law (section 213 of the Criminal Code of Canada) forbids anyone who is in a public place, a place open to the public, or a place in public view from 'communicating, or attempting to communicate, to any person in any manner, for the purpose of prostitution.'

Essentialy once a camera is involved it becomes a documentary on sex. The money part is irrelivent at that point and it is covered under first ammendment rights.

The camera being involved is what protects you.

This is not the case in EVERY state. In many states you can be charged with solicitation for making a porno. It's been done before.

Laws change in large part because of strong lobby efforts by interested parties. Who's gonna lobby for hookers' rights? Prostitution is illegal in most states because we allow it to be.

Meta 07-30-2003 01:08 PM

I would rally for hookers, they are great, every man should own a few:thumbsup

Dax 07-30-2003 01:14 PM

This is THE answer:

When u fuck a hooker u are paying for sex.....

When u do porn.. u are paying FOR THE RIGHTS TO THE VIDEO. So you are fucking her not for pleasure but to make money off of it and because the camera is there.. then is protected by freedom of speech.

Blah! easy answer!

because when you shoot a porn film, you are paying not for sexual gratification but to film sex-

Digipimp 07-30-2003 03:45 PM

Yeah that's why when I cruisin for hookers on Harry Hines in Dallas I always take my camcorder with me.

Well that and for when the police start beating my ass cause I say I'm just making a documentary.

what about woman who only date a guy because he drives a lambo?

ytcracker 07-30-2003 03:47 PM

fuck the police
fuck fuck fuck the police

GeXus 07-30-2003 03:52 PM

The reason is because of taxes, And most hookers "solicit" which is illegal.. people complain about it too, And because of deseases, since being a hooker is unregulated.

People have a choice if they want to look at porn, they either do or they dont, but with hookers standing on the street corner shakin there bootie, people dont have a choice..

Yes, and of course, everyone knows how well them pornstars can act! :winkwink:

freeadultcontent 07-30-2003 03:58 PM

Nearly anywhere depending on the DA, porn actors could be charged with prostitution and hiring them could get you brought up on pandering charges.

Simple fact of the matter is this. If the DA wants to bust you they can, if they do not want to they will not.

that's only because it's illegal, if prostitution was legal it could be regulated and operated in houses and shit with testing and get taxed. And you could crack down hard on the street walkers because they would have no excuse then.
