Yes he is, permission was not asked to allow surfers to bypass the banners and advertising.

There's no law telling surfers to WATCH banners and advertising. And there's no terms and conditions on the gallery pages saying that watching banners are required in order to watch the pictures.

If you don't like programs like that, protect yourself against it.

actualy, most of my galleries have copyright statements stating that no part of the gallery may be reproduced in any manner. This program is reproducing them to surfers hard drives though their program. So techinicaly there is now a problem. I don't have to protect if I don't want to, mind you I will be adding that shit to htaccess but I would rather see the company get shut down, End of story. And if you want to get really techinical abotu it. I saw sponsor content get downloaded to my folder with that program. 99 percent of sponsors clearly state that a link to their site(s) must be present. This program shows no links to any sites except their own page where surfers pay them for the program. Where's my cut... this is going to get ugly. I won't rest until they are gone. Simple.

How is something like this legal? They're stealing copyrighted images, aren't they? Forget the fact that they're bypassing banners. They have no license to use these images or to present them in way, shape or form, or am i missing something?

The program is downloading pictures and presenting them in some form... Hey, just like a browser.

It would be illegal if the program reproduced these images on another site or in another form. But its not. It's representing the pictures as they are. Not altered or anything. Just like a browser.

I thought I politely told you to shut the fuck up. You're out of you're league here. Where there is a will there is a way. There are many legalities about this that can be applied. Galleries with copyright notices wil take care of that.

Digital Millenia Copyright Act prohibits this kind of thing, but there must be a dozen of them available all over the web, including on download.com and tucows and other free download sites.

Any decent programmer could write one for windows in about 30 minutes then polish it up in about an hour and have it up on all the download sites by the end of the day....

oh and cali, to get more technical about it.... the program IS displaying them in another form. I dont see my banners, desing, or layout that I see in http://collegeagecuties.com/freegall...y/indexgal.htm if these pics are downloaded to the surfers hard drive.

I also see the program breaking my terms. Look at bottom of page and at source code.

This is asuming the program grabs pics from this gallery, that would put them in hot watter. If the program grabed those same pics from someone else's gallery that promotes socal coeds on a totaly different gallery, this has nothing to do with me. But if this gallery gets parsed by that software, bingo, they are in the wrong. I am interested in making sure nobody has to worry about this shit happening to them. Or am I totaly mistaken and full of shit this morning for wanting to get rid of a piece of shit like that?

Now where did you read that?!? I have kept my personal opinion about this kind of programs out of my replies on purpose, I merely claims he didn't do anything legally wrong. If I like what he does or not is not the issue here and my personal opinion about it is irrelevant to the thread.

I remember years and years ago (before most people with loud mouths who post here were even in this biz) when everyone was so pissed off becuase the hun linked directly to content pages of websites instead of to the entry/main pages. People screamed up and down that he was hotlinking, that it was illegal, etc. Now they're just called tgp sites.

Sorry to say, but this program is NOT doing anything illegal. Do I agree with the program? Absolutely not. But that doesn't mean it's illegal. However, attacking and taking down his site IS illegal. Not the kind of extra heat our industry needs at these times.

Not exactly. Browsers go to webpages which are licensed to present those pictures. Software like this downloads the image and presents it. They have no license to do so, therefore it is illegal, surely?

Also. You can prevent these programs from surfing your galleries using htaccess. Something to do with the http agent. Someone started a thread on GFY recently with a huge list. I can't be arsed finding it.
