Acacia Strikes Again - 3rd Attempt
 
I recieved these from Acacia today, anyone else get theirs yet? This is their 3rd attempt to fuck with me, the first time they sent an email late last year which I repleid to with:

FUCK OFF WITH YOU GOD DAMN SCAM YOU ASSHOLES!!!

The second attempt was their packet which I have yet to ever read (don't like things that bore me within the first paragraph)

Now this is the third and final attempt, wow, should I be scared into settling?

NOT!!!

Sorry didn't know my scanner needed cleaning before I scanned, it was in a box for awhile hahaha.

Brent I feel for you big time! I can't believe they are doing this over the holidays!!! Very low. Not only do they threaten you with litigation.... they do it over the holiday season.

Do these people want to get what they are requesting? It seems everything they are doing, and the way they are doing it says no.. they are just trying to punish us for being in the adult industry?

Brent I'm sorry this is happening man. I went through litigation last year that laster 9 months.. I was served right before thanksgiving and I know how this stuff feels.

That was my old biz address, no longer there and if they really wanted my new address all they have to do is whois or look on our site under support or contact hehehe, not a big deal I doubt there are any stalkers in the adult biz and if they are I am too ugly to worry about it;)

Be ready for the next wave, which my guess is they will file a bunch of lawsuits, and have that "convince" you to settle out of court. Full court press...use the legal system to intimidate people into signing, especially before the defendants can get to court and argue their defense..

THERE ARE NO REFUNDS ON THE LICENSE FEES WHEN THE PATENT IS FOUND INVALID!

As much as you may hate it, ignoring them is the last thing you want to do. Get a lawyer, and get one quick.

If they get a default judgement against you, they'll lock you out. Already did it once before and they used it for another press release.

The article you reference here http://www.cd-media.net/acacia/acacia03.jpg shows that the only reason they won the first injuction, which sparked all of this contraversy, was because 5 adult site companies didn't show up for the hearing date... allowing Acacia to win the case.

This is why it is SO IMPORTANT to support HomeGrownVideo and Fight The Patent. Home Grown has been there.. steadfast through all of this .. and them standing tall and fighting the fight will eventually lead to a victory for all of us.

As we know, and have shown many times, this prior art does exist. But ignoring the letters only leads to trouble, but then fighting them leads to expense and signing the agreement.... well this is a decision for each person to make and I don't envy you Brent. Thank you for sharing this info with us.

Has anyone else got this 3rd letter? Or are you not wanting to post regarding the situation?

See the one thing alot of people miss is the fact that an LLC or INc covers your ass in court cases such as this, anyone ever watch the movie where the insurance company lost to a family who's son had died and the insurance company denied their claim for years and they owed the family millions of dollars, so they turned around and filed bankruptcy and the family never got a cent, there are other waysin life to make money then by feeding these bottom feeders with the likes of our wallets, fuck them and their mommas too.

47 out of thousands and every one of those 47 was nothing but a sweetheart deal.

Eventually they need to try and get a real non-sweetheart license, and then resistance will stiffen even more. 30 million in the bank dont go that far fighting dozens of lawsuits and peanuts coming in.

Well I am just glad to see that being one of the first contacted with a sweetheart deal last year that I am still here fighting and I got associates who are fighting the same cause. It's good to see the adult biz come together and fight the good fight when it is needed!!!

Same reason as they are off showcasing Hustler and Vivid, because someone buried in their agreement probably says they could.

I believe the issue with CE is that rather than referencing them by their corproate name, they were using the CE and CEcash names, where are trademarked, and so CE was probably trying to go after them for mis-using their trademark.

I thought I had read somewhere that Berman was dismissing the confidentiality infringement as being a non-issue since their licensing agreements allow them to disclose the names...

otherwise, no company would want their name to be used, and they would have nothing to put in their Press Release statements except: "some company that does some things licensed our patent"

We did change our site to no video samples and no downlaods after we got the packet, but the sad thing these fucks don't even bother asking about is that I have only been selling video on my site through download or samples now for about 2 years and I am no longer infringing till this is invalidated so they truely want to spend that kind of money to get $1500 x 2 out of me?

They are truly stupid if they spend the time and money to come after me for $3000.00 one time fee and never a penny after that, waht a bunch of fucking tards.

I haven't done enough video sales to go over the $1500 a year fine.
