Durst Sues Fleshbot Owner Over Sex Tape
 

Limp Bizkit lead singer Fred Durst has filed a lawsuit against Fleshbot parent company Gawker Media and a host of Internet service providers in an effort to squash the sale of a video of Durst having sex with a former girlfriend, according to legal documents obtained by XBiz.

Copyright protection subsists from the time the work is created in fixed form. The copyright in the work of authorship immediately becomes the property of the author who created the work. Only the author or those deriving their rights through the author can rightfully claim copyright.

It makes sense that Durst's lawyers went after Fleshbot et al, since they are the ones currently hosting the content, and the injunction can be enforced against them.

I'm just a little curious though, because it seems as if more and more celebrities are cashing in their fame for some porn coin, and more fame.

Pamela Anderson and Paris Hilton also filed lawsuits, but it seems as if nothing came of these (at least so far). It just provided more publicity for the tapes. Even if they didn't own the copyright, supposedly they didn't sign releases either.

I want to see Carmen Electra do it on camera with her newest hubby Dave Navarro (guitarist for Red Hot Chili Peppers and Jane's Addiction), although I would want them to release it and profit from it, and not some dirtbag(s) who stole it and released it without permission.

BTW, lots of rappers (Snoop Dogg etc) have appeared as hosts (not performers) for tapes, and there was talk of some rocker doing the same - anybody remember who that was?

I just got off the phone with the editor of Fleshbot. Fleshbot did NOT host the video. They are being sued for LINKING to sites that host it.

That is fucked up. If a celeb tape is online (legal or not), that is news and fleshbot and other bloggers should have every right to talk about and link to the sites. Now, suing the people that host it is entirely different.

Interesting. While I'm sure this pisses off the Flesh crew, it sounds like it could turn out rather awesomely for them. They might have to spend $50k in legal fees and a fair amount of time, but they've got a very solid case, so I can't imagine they'd lose. Meanwhile, Limp Fred will drive a new level publicity and traffic their way.

If they weren't a news-like site, I think their defense would be harder...a lot of people think they *should* be able to link to other sites, since they're just links, but I think the RIAA has pushed through some laws that make such linking questionable. However, being a new-like site, and discussing the content on the copyright-violating sites rather than just providing links, provides some fair use and freedom-of-press defenses that other sites might not enjoy.
