Is re-drawing popular cartoons having sex illegal?

Trying to get opinions, my lawyer says yes but she says yes about everything.

I am thinking as long as it's not saying the name of the copyright image then it should be fine. makes since :disgust

Assuming is a pay site as well.

I would imagine so, unless you have permission from the creator.

Rich 06-11-2005 01:31 PM

I would imagine your lawyer is right, a cartoon likeness has got to be trademarked.

GatorB 06-11-2005 01:33 PM

No, your lawyer is stupid. Go draw Mickey Mouse fucking Minnie. Disney won't mind. :winkwink:

Think about it, you're making money off somebody else's creation. It's copyright infrigment. Especially when you're talking about making money by using Disney-like characters. These guys don't kid around. Don't go there and have a cartoonist create some unique characters. Cartoonsex sells, even when it's not Disneyporn.

Well, all the guys I know from back in the day who were drawing other people's shit in a porn theme aren't working anymore. Except the ones in sweat shops in some Asian dungeon.

I'd say it just might not be a smart thing to do UNLESS you consult an attorney who knows EXACTLY what you can and can't do.

Besides, why would you wanna when you can make up your own?

warlock5 06-11-2005 02:43 PM

Its ok if its a "parody" -- otherwise, no.

If it was a parody, it would be okay. However, since you're doing it to make money, it probably might not fall under the classification of parody under the exceptions carved out under US copyright law.

Even 'fan art' is not legal (although copyright owners rarely go after these cuz most are noncommercial in nature) since they fall under the DERIVATIVE WORKS section of the copyright law.

Parody is okay in some circumstances. There are plenty of adult parody comic books that come out each month that are based on cartoons and movies. These companies tend to change everything about the plot of the story though and basically just capitalize on the name suchs as The Matrixxx.

chaze 06-11-2005 04:11 PM

Interesting, so what's the guidelines to keep it a parody?
