Re: Secondary Producer Records Pursuant to 18 U.S.C. § 2257

To Whom It May Concern:

I represent OC Cash Media. We received your inquiry concerning copies of records for secondary producers. I am very familiar with 18 U.S.C. § 2257 in my capacities as a First Amendment and criminal defense practitioner, the Chairman Emeritus of the First Amendment Lawyers Association and the Chair of the Board of the industry?s trade association, the Free Speech Coalition. I write this letter exclusively in my capacity as OC Cash Media?s attorney

Despite General Gonzalez? efforts at reviving the concept of ?secondary producers? in the most recent version of regulations in support of 18 U.S.C. § 2257, the concept is not supported by the statute itself. The only case addressing the issue, Sundance Assocs. Inc. v. Reno, 139 F.3d 804, 807 (10th Cir.1998), held that the ?secondary producer? requirements of the regulations to be unconstitutional. We rely on that holding, and further decline to violate the privacy of the performing artists by disseminating private data when not required to do so by law.

If you have any questions regarding this policy, please do not hesitate to call, or have your attorney do so.

Sincerely,

The Law Office of
Jeffrey J. Douglas

I must tell you, he is taking a powerful stance.

DOJ Example number one perhaps? Sure it's great for the attorney... he'll make a rake load of cash...

It's not so hot for the sponsor... they have a 50 50 chance of winning and still pay the laywer.

It sucks ass for the affiliate/promoter... they have a 100% chance of not being defended by this a-hole if he's wrong. No Go on the Bling Daddy's side.... :)

xxxjay 06-22-2005 01:44 AM

Whoa, that was quick...I tell you what...after the 23rd, let's all discuss it.

You keep paying the fear mongers and the ambulence chasers. OCCash will keep paying the people that are (and have been) hard at work at the injuction and subsequent lawsuits...

Then we can talk.

Wait till you see what OCCash does on the 23rd -- its gonna rule.

xxxjay 06-22-2005 01:45 AM

Oh yeah, by the way, your lawyer is a good one - I was just playing.

I use a lot of them, Clyde has been a friend since 1995.

xxxjay 06-22-2005 01:48 AM

And, oh yeah, btw...Clyde DeWitt is our primary producers lawyer btw...if that helps you any. ;)

I Use JD Obenberger and Jeffery Douglas. Both are amazing. Jeffery Douglas is more radical, brilliant beyond normal comprehension. He has been in the ring and stood toe to toe with our enemies before. He knows what he's doing. Obenberger is as sharp as a tack, more conservative, but if you ever heard him speak its like Beethovens 7th. This is the dream team in my opinion. I am honored to have them both as my attorneys.

AlienQ - BANNED FOR LIFE 06-22-2005 02:00 AM

He is absolutly correct though.
Maybe I should retain em as an attorney...

BlingDaddy 06-22-2005 02:01 AM

Like I said.... the laywers get paid..... the workers get....

I agree. Jeffery Douglas is SO SMART and so SHARP that it really blows my mind. You feel a lot better after you talk to him. JD is a friend and I have reffered him to other friends that he's done great work for...he is not to be ignored. Niether is Clyde...all of these guys are at the top of their game. Even Greg P. -- he's a bit of a "scare tactic" guy, but is an amazing public speaker. I would want Greg or Jeffery defending me if I was in court for sure.

Put it this way...I have often considered quiting what I am doing to become a lawyer myself, I'm not a dumbass. I can understand complex legal shit and I can tell when someone is BSing me and when they are not.

Yep... the best night's sleep I've had in the past months was the day we hired Jeffery and learned what's going down with 2257.

Top notch :thumbsup

No doubt Jay... we didn't even discuss it at the San Diego show..

I'm in Denver this week and might go to the hearing if I can get in.

:thumbsup

Major (Tom) 06-22-2005 02:25 AM

lets just hope the stipulations get past the litigations and the postulations and promulagations because this law is an abomanation! (my best johnny cochran impression to date).

If the glove does not fit... you must acquit!

Seems fairly appropriate here too. :thumbsup

Oh yeah, Baddog - when I met you in San Diego...I really resisted my better instincts and didn't sock you square in the head. Now I am regretting that decision.

Why don?t you make some money in the business (like I do) before you sit around and talk shit about the people that really do --- you worthless nobody.

Any time you want to bring it on ? I?m in Hollywood?right over the hill from you --- you fucking fag.

upset that I find the idea of a convicted felon becoming an attorney amusing?

That shit has been expunged from my records for years. By the time I finished law school in another four years that would be so far in my past it wouldn?t even matter. I?d gladly catch another charge to knock your yellow ass teeth out though.

I?m loco, bitch.

Expunged? That is interesting. That was only what, 2 or 3 years ago, tops that you reported to us that you were thrown in jail for your website, when in reality it was for a failure to appear.

Yes, that was from some bullshit in 1996. The judge cut my shit in 1995 and allowed me to move out here. It was a first offense and a minor one at that. I'm not embarrassed about it or afraid to talk about it...so bring it on.
