its not like they are going to say "uh... yeah. our position is really weak and we are wrong about many things... including the constitutionality of our decisions" - all the issues were raised to the DOJ before they modified 2257 and they basically said "ok. we heard you. now fuck off" to all objections raised including the sundance vs. reno case and the secondary producer issue.
they are in a position where they have to fight to the end and any comment from them is going to be of this tone.
