I figured that since the Xbox 360s are coming out next week, I'd just have a look to see what they're going for and I stumbled across this auction that was just about to end -

If you read it, it does say in the first sentence that it is the box and it doesn't come with the hard drive, controllers, etc... That is quite devious. Can you imagine not reading that and paying $530, then getting the package in, ripping it open and having an empty box, I'd be pissed.

I guess that it's all about reading the description before bidding.

Nah, this has been going on for years. They will have to give back the money / account frozen. Remember that eBay owns Paypal also. Its misleading and stated very prominently in their EULA because people that have issues with English cannot understand that box means packaging rather than the actual box itself. I see that constantly.

get this Laptop Picture for $1,000 and people bid on it thinkin its a laptop...its just a picture they're bidding on.

there was a case just like that in court (i read it a couple weeks ago), even though it was CLEARLY advertised as a PICTURE of a laptop, the people who bid on it won the case cuz the guy was intentually trying to mislead the buyers.

dont worry, the stupid person who won the action will get their money back. and tomorrow, it all starts over again.

nope, you bid, its a legal binding contract, playstation 2's started this and the shit was all over the news, the dude had to pay 500 bucks for the box and Ebay said it's a perfectly legal transaction...

however i do notice a few things here that can get the seller in trouble
specifying box is Brand New,

(how can it be brand new if it was opened and contents removed?)
and also going out of the way to describe contents of the box
which are overselling/misleading and can be considered fraudulent
