Can you get in trouble for a logo like this
|
no

depends - since you are not in direct competition - there are many logo's that have the same feature - best to discuss this with your lawyer before going any further. Eg. crowns are often used in many logos from burger king to crown corp that manufactures plastic moldings etc.
|
Well, since most companies trademark the name as well as the art, I would say that they would probably have a valid case against you. If the mark is potentially confusing, then they have a case. Just looking at it, I would say that the mark would be potentially confusing as well as damaging to the original trademark holder.

i say maybe
|
yes you will
|
i'd think so
|
Yes, it would probably be ruled as infringing

yeah, you'll get in trouble, people are lookin for any reason for a lawsuit nowadays. be careful.
contact me if you want a different one designed :winkwink: |
maybe...but fuck it, use it anyway
|
most things are covered under U.S. parody laws as long as it's all in good fun.
but I don't think a penis will hold up in court (no pun intended) |

depend on where are you going to put tha logo...near the church?
|
haha both the logos made me laugh
|
Of course. Can I have a site called McPorno? And have a yellow rounded M with a red background as my logo?
|
I would think so, and would have to say that it would not be worth the time and trouble.
But Look at booble.com |
maybe, maybe not, but why risk it. plus im sure the company wouldn't want to be associated with an adult-related site.
|
Bet your ass you can...you may ultimately win but do you have more money to throw at lawyers than in n out burger?

Because you are not in competition I think it could be ok.
There is a sign here that looks damn near exactly like the Warner bros logo, but its for a steel manufacturing corp, so they cant do anything. |

If you planned to have it displayed near a school zone then I guess you're fucked. |
Yes, you will get heat for it...
The reason SNL doesn't get busted is because it is a parody.. Yours is not. You are using your logo as a commercial front end to your business. If you did a post on a blog with that, you can... but you cannot use it as the logo for the blog itself. |
I believe they have the actual yellow symbol registered. If they had the whole thing registered then they would put it closer to the end of T on OUT or at the R of BURGER.
|
My first reaction would be to say that yes you would get in trouble for it but then again I see so many t-shirts that have tons of mainstream logos with funny messed up shit on them, but who knows how long they stay around.

If you have to ask . . .

|
i would say yes but who really knows
|
You're asking me?!?!?!?! murhahahahaha
When their lawyers write you a love letter, post it on the web, and send out a press release. Then kick back and watch the traffic pour in <vbg> |
