depends - since you are not in direct competition - there are many logo's that have the same feature - best to discuss this with your lawyer before going any further. Eg. crowns are often used in many logos from burger king to crown corp that manufactures plastic moldings etc.

Monique Niccole 03-09-2006 03:32 PM

Well, since most companies trademark the name as well as the art, I would say that they would probably have a valid case against you. If the mark is potentially confusing, then they have a case. Just looking at it, I would say that the mark would be potentially confusing as well as damaging to the original trademark holder.

RayBonga 03-09-2006 03:45 PM

Only if you use something like this:

http://imagemdodia.com.sapo.pt/logo.jpg

VicD 03-09-2006 04:47 PM

i say maybe

axelcat 03-09-2006 04:48 PM

yes you will

Manowar 03-09-2006 04:49 PM

i'd think so

EdgeXXX 03-09-2006 04:58 PM

Yes, it would probably be ruled as infringing

CyberHustler 03-09-2006 07:01 PM

maybe...but fuck it, use it anyway

Young 03-09-2006 07:07 PM

most things are covered under U.S. parody laws as long as it's all in good fun.

but I don't think a penis will hold up in court (no pun intended)

Bluewire Ross 03-09-2006 07:46 PM

depend on where are you going to put tha logo...near the church?

60grand 03-09-2006 08:29 PM

haha both the logos made me laugh

GatorB 03-09-2006 08:34 PM

Of course. Can I have a site called McPorno? And have a yellow rounded M with a red background as my logo?

czarina 03-09-2006 08:36 PM

I would think so, and would have to say that it would not be worth the time and trouble.

But Look at booble.com

bdld 03-09-2006 08:40 PM

maybe, maybe not, but why risk it. plus im sure the company wouldn't want to be associated with an adult-related site.

mikesouth 03-09-2006 10:09 PM

Bet your ass you can...you may ultimately win but do you have more money to throw at lawyers than in n out burger?

haha...that wouldn't be good but it would be fun

jeffrey 03-09-2006 10:22 PM

Because you are not in competition I think it could be ok.

There is a sign here that looks damn near exactly like the Warner bros logo, but its for a steel manufacturing corp, so they cant do anything.

Yes, you will get heat for it...

The reason SNL doesn't get busted is because it is a parody.. Yours is not. You are using your logo as a commercial front end to your business. If you did a post on a blog with that, you can... but you cannot use it as the logo for the blog itself.

chechnya 03-09-2006 11:24 PM

I believe they have the actual yellow symbol registered. If they had the whole thing registered then they would put it closer to the end of T on OUT or at the R of BURGER.

ready lube 03-09-2006 11:36 PM

My first reaction would be to say that yes you would get in trouble for it but then again I see so many t-shirts that have tons of mainstream logos with funny messed up shit on them, but who knows how long they stay around.

baddog 03-09-2006 11:41 PM

If you have to ask . . .

IN-N-OUT alone is probably trademarked

Michaelious 03-10-2006 06:29 AM

i would say yes but who really knows

BoobleBob 03-10-2006 08:29 AM

You're asking me?!?!?!?! murhahahahaha

When their lawyers write you a love letter, post it on the web, and send out a press release. Then kick back and watch the traffic pour in <vbg>
