I have one of those themes and recently had a huge fight with one of the program owners due to the header having a link to a different program. ie gallery page on my blog and the header promoting a diff program.....

yeah your cross promoting, if the header was promoting the program that was linked then i'm sure they wouldn't have a problem with it...
