Big Drama Coming Next Week - Set your tivo-

We are coming to clean house.

Curioustoyboy- you are at the top the list with papfilth and your affiliates counter-dmca this week. You are the biggest thief on this board and we will prove that.

The rest of the thieves will get their chance in the spotlight along with the thief lindsey. All of you will be outed and the confusion you have caused and damages you have all caused will come back to haunt you.

One of the drama targets is a top sponsor here and will have some explaining to do as well to you all.

These thieves who steal The Paris Hilton Sex Video have put all of their affiliates at great risk. They also encourage user-submitted sites to continue down the path of profits at the expense of the true copyright holders.

Judgement day is coming and we look forward to sharing the experience with you all.

Other content rights holders should step up to the plate and go after infringers as well.

karlm 07-06-2006 02:57 PM

Oooo drama smells bad

BoyAlley 07-06-2006 02:57 PM

sig spawt

XPays 07-06-2006 03:00 PM

A top-sponsor on this board posted to me that he had newsworthiness as his justification for posting clips and images on his affiliate tours and paysite and he told me here "there was nothing XPays could do about it".

SURE PAL! We are coming for you!

XPays 07-06-2006 03:02 PM

Let's see if lindsey the human spectacle makes time for depositions in his busy travel schedule too.

Jace 07-06-2006 03:02 PM

haha, this will be fun

xclusive 07-06-2006 03:03 PM

Damn, Hope that something can be worked out.

~Ray 07-06-2006 03:04 PM

I'm sorry

XPays 07-06-2006 03:04 PM

and to be fair- we are including the processors, hosts and affiliates.

all contributary infringers will go down with their partners.

XPays 07-06-2006 03:05 PM

ccbill and paycom have been 100% above board and we have no problem with them. they follow the dmca to a T.

XPays 07-06-2006 03:06 PM

segpay and verotel amongst others can expect a busy fall and beyond.

What if we promote these companies for tapes they do have, but not for the Paris tape, all Paris ads/links go to xpays?

karlm 07-06-2006 03:13 PM

Get them to indemnify your company and post a bond if you can. juicybucks when alison williams suits went down just abandoned everyone though for example. it seems they have gone a new direction but that is one example of the u.s. affiliates getting left to fend for themselves.

The simple answer is that in the light of your question, we would not have a problem with you because we are only enforcing on The Paris Hilton Sex Video. Secondly, we review site compliance upon request within 24 hrs if a webmaster writes in.

We are not on a witch hunt and in order to preserve our dmca enforcements at google- we HAVE to sue now. too many thieves are filing counter-dmca's which force us to sue fyi.

XPays 8 Year anniversary is in 3 weeks- you can trust us with your Paris Hilton Sex Video traffic going forward. Also, several programs have legit dvd sales stores you can promote. As long as the dvd is not counterfeit and only the box-cover is used to promote then you are safe. There is no reason to leave money on the table.

one reason is that we have 10 days from the counter-dmca lindsey's affiliate filed with google so time is of the essence.

XPays 07-06-2006 03:31 PM

again, we very much appreciate the continued support of the legal marketers on the web and look forward to the increased results we will all share as the thieves like lindsey are continually addressed.

XPays 07-06-2006 03:39 PM

the infringers who claim to have 2257 better be ready for us to hold them to that. anyone think that a failure to produce doc's might turn criminal for an infringer?

another rights holder has used this strategy in a case before- successfully too.

cyberstar 07-06-2006 03:50 PM

lindsey - thief?? i can't believe that!

well he is knowingly violating a prior settlement agreement between verotel and our side. lindsey's company continues to buy sponsored links and affiliate traffic making use of our copyrighted images and has had a pattern of doing so after repeated attempts to have him cease and desist and now his affiliates are claiming that papfilth gave them rights that papfilth does not have. and on and on. he also is known to gossip about his web of foreign banking and stuff to insulate his company from legal issues. but verotel, his gateway has a u.s. presence as well as holland being a party to the hague convention treaty. i can go on and on but you'll be able to read the actual complaint soon enough.

Why 07-06-2006 03:56 PM

well this should be interesting to watch unfold.

word- on the surface lindsey seems like a nice enough guy, maybe a little verbose and arrogant, but beneath the surface you will find out what a thief he is as the days roll on.

Hey xpays answer me this please, If an affiliate sells the tape without knowing that you have copyright, would you still fucking him over.

not that i have been, but i think its a bit unfair to go after an affiliate whos in the dark.

cool- it should be a meaningful case to our industry for the following reasons in my opinion:

* Dmca
* foreign infringers
* copyright law in many ways. the newsworthiness and gossip defenses made by commercial non-news sites will be interesting.
* known members of gfy and the community
* u.s.c. 2257 implications
* use of laws protecting contracted parties from a third party that attempts to induce a breach between the contracted parties.
* contributary infringers enforcement
* USER-Submitted content Sites.....

BusterBunny 07-06-2006 04:25 PM

what if paris told me i could sell it, in the heat of passion during our last sexual encounter?

definitely not and we agree with you. when you see the multi-year patterns of certain sites though- there is no choice left as all other means of resolution have failed. it all depends in each individual case and of course but trust me when I tell you that it is a black and white situation. the grey area is long gone with the particular cases here.

lol. join the club-- j/k we have a great paper-trail or we would have never contracted to market and now enforce.

just one more comment on this- ignorance is not a defense for an infringement suit. so my answer earlier is missing the obvious- which is that faking this would not help somebody in their defense.

Brujah 07-06-2006 05:02 PM

This is why you should send your Paris Hilton traffic to ANY DVD sales site. Mallcom.com, Redlight.com, etc..
