normaly when we want a person off the property for not paying rent they are more than willing to just go ....

i went and talked to the lady today and told her that i have no other means of solving this other than to evict her and she said " good im sure you know the proper steps to evict someone until then I am the resident here "

A formal eviction through the courts is a judgement and automatically goes on her credit report as an eviction and a judgement. The problem may be if she has financial issues and files bankruptcy she can get a stay on the eviction (well, in CA you can) until the bankruptcy is finalized.

actuly you can just post a notice of eviction by x date, your the landlord i'm sur eyou have a clause in the agreement somewhere where you have to give them a written notice to leave. Go go the sheriffs and have them serve the papers so its documented they were served on x date. then goto court. my gf is a property manager at an apartment complex she evicts 3-4 people a month on a 600 unit complex. I'll get the full details in the morning when shes awake :)

I don't think I can do that in TX
it has to go thru the courts
but 99% of the time people just leave


we have a sound contract with her so no biggie really... just wish she would just move on and not make it hard

It only takes 30 days for an eviction? I've seen it upwards of 4-6 months here and we're evicting 3 units right now from these deadbeats. This property I got into is an absolute mess and we're actually going after the former property manager for fraud for overstating the books prior to the sale of the property.

I think it all hinges on the state you live in. I used to live in an apartment complex where a guy living next to me hadn't paid rent in 9 months. He was friends with the manager and she never reported it to the owners. The fired her and put new managment in. It took them almost 6 months to finally get him out of that apartment. they had no income from that apartment for 15 months. pretty crappy.

Dude that sucks ...make sure that you read up on your rights as the landlord but also read up on her rights as the renter, often the renter has way more rights than the landlord depending on your state
