You need to put your money where your mouth is already. You've had your day in court, now back it up with documentation. There are two sides to every story and I have an odd feeling your side is a bit left of the truth.

FHM lets tell what happened in court.. First off the 1900.00 you said was owed to you was not.. She said it was only 900.00 due to the fact that you had a affidavit from the programmer that was involed in this project.. After I spoke with him all he had to say was ,

my statement was 2 sentances
that said checks were in my name and signed over into an account that wasn't mine
the rest was editorialized and I didn't have the patience to fight it
and had there not have been a notary 10 ft away
the only thing compelling me to comply
was learning that I was your defense as well as the name to which checks were made out

I'm not saying anything was made up. There is no doubt in my mind that they went to court. Once you end up in court, pretty much you shouldn't be making public comments about the case.

So provide documention or bugger off already.

Why not? Shouldn't others in the industry be warned of products and services that are scams or fraudulent? Isn't that the crux of a webmaster board? I mean it's fun to watch the outsourced sigwhores post 50 times an hour to win 25 bucks in a thread, but I think issues like this are actually important to the board.

Arbitration is usually a split down the middle to not waste court time and tax payers money based on the evidence provided.

This guy is blasting Zuzana Design. But if I understand correctly his beef isn't with Zuzana Designs. Zuzana Designs never did any work for him, and Zuzana never collected any money from him. This is about a Toby, who was doing some work on the side.

At the end of the day, it really seems to me like someone is being very loud about a small amount of a money and a misunderstanding.

In other words, the evidence provided wasn't proof enough to award you full damages. Instead, you were both told to stop wasting the court's time and play nicely from here on out.

But you failed to mention in your post that you got less than half of what you were asking for.

Not to mention you constantly slamming a business here, when in fact your beef is with an individual whom at the time wasn't acting on behalf of the company your slamming.

She has stated he works for her. To what capacity we can all imagine. I've never mentioned Sarah being involved with any cash in this deal.

Toby was the primary contact and then just disappeared. He has had his chances to make good but choose to be silent and left me with no other choice.

The suing amount was $1,900, but it?s not about the money it?s about the principle.

Sorry I'm not an attorney and didn't have everything I needed. I didn't appeal and he didn't appeal, so now he owes me a judgment. I would of had more ammo if we needed to go before a jury. I have also posted many times how much he had owed me. There are a few threads back in the day, where he choose to ignore.

sarah and Zuzana designs is top notch in my book. I have done many deqals with them and even paid up front. i never got fucked over by Sarah. Whatever the issue are with Toby, they have nothing to do with Sarah and I think that should be made clear...

I guess I should take that as a "NO" answer. I wish you would re-consider. I'm back to work and got the answer I needed.

Come on, I'm sure you've either been through or heard of arbitration. You rarely get the full amount and it turns more into a settlement than anything. If he had no case at all, he would never have been awarded $900. They don't just award people money for no reason.

just pay up and move on.

This is what I'm getting at. While one person is dragging Zuzana Designs through the mud, others are doing business with her / them and not having any problems. Zuzana Designs has done a lot of work for me, in bulk, with amazing turn around time, and I'm not even sure if we've paid her yet.

I've been through arbitration once. It was with an apartment complex that refused to give me back my deposit because they "paid an outside company to come in and clean my blinds". They even provided a fake receipt from some company not listed in any phone book.

What they didn't know at the time is that my room mate was super hot and was wearing short shorts while cleaning the blinds. Me being who I am, I took some pictures of the event - her on her hands and knees cleaning the blinds, which we removed from the windows and had laid out on the floor. This was 1991, and the picture had a date stamp on it.

I won my $1200 deposit back, plus $1200 in damages because the apartment manager lied about everything AND provided fake documentation during arbitration.

The apartment manager was fired the next day.

FHM, I hope you get your money back. Granted it's not what you paid but it's still better than nothing.

From what I read, there's a history of this M.O. and a few GFY'ers have been detached from their funds from the same 'people' or group.
I'm basing this on a few searches - I can understand some people not being happy with a design but it's more like money & work done don't go together - unless it's two seperate companies using the same name - why do the work and give what people pay for with some contracts and not others?

anyways.. have had problem with sarah (zuzanadesigns) months ago.. a few drama and bullshit that would never happened if they fixed the problem asap..

I've thrown a lot of work Sarahs way and it has always been delivered, fast and top quality. It's seems that these threads that some asshole keeps throwing up are about attacking Toby's work , but to make it hurt Sarah by dragging her company name into it, when as you can see is not on the court doc's. So do us a favor, don't be an asshole!

That is exactly the problem if you let go such discussions on a board. It´s quite easy to slam a company here, but obviously there are huge differences between posted stories and proven facts. So I do not see any need to post the story again.

A webmaster board can not replace courts.

i dont know any of the people involved so i wont comment on them...

i have a feeling a lot of people on this board would be inclined to move work for adult.com or gfy mods to the front of the queue. im not suprised at all that you and Rochard had fast turnaround and quality work from zuzana or anyone else.

anyone that would deliver shitty work to you guys needs to have their head examined. im not gonna deliver poor quality work to any clients but i can promise you, if you call me up and want 500 dvds encoded in the next 30 days ill go out and buy 10 new boxes and have your work done early and checked over twice before its sent out.
