Well, my attorney got an email reply from DirectNic. They want me to confirm the models ages of the first 14 thumbs on Major Pervert. If I can do that, they say they'll let this go.

They did also extend the deadline, although they didn't state until when, so they are willing to work with me and making it easier on my by requesting for 14 thumbs rather than every one, so they re being more reasonable and willing to get this solved, I do appreciate that.

No, don't react like a dumb webmaster. They made a (silly) demand, but then gave you some leeway due to legal issues. Give them some leeway too, don't be an asshole (I am fairly sure you won't be). They say they want you to 'confirm', so confirm! ;) Then it's a battle won. By you.

I would comply for the sake of your domains. Then I'd move those domains off them as fast as possible. I couldn't fathom using them as a registrar after this.

But in my opinion directnic are just looking out for their own best interests, as any company of good consience should be doing.

If it were me I think I'd just show the proof (or get my sponsor to show the proof), and move on. SAVE ALL EMAILS AND CORRESPONDENCES pertaining to this matter though. If anything crops up like this in the future you will have some reference material to show that says you were found to be opertating above-board in the past.

But hopefully nothing like this happens to you again man. Good luck.

How is he going to comply. How many sponsors do you think are actually going to just hand over this info to any affiliate much less some non government entity.

Furthermore, its a lowly law clerk making the demands. Maybe the law clerk should stick to studying and prepping for the bar exam.

Direct NIC has no legal grounds to stand on and will lose big time if they decide to pursue this further.

Yeah, that's a good question. I hit up a couple of sponsors that I know well on ICQ, so we'll see if it's possible. If it is with them, I'll hit up the other sponsors that I have no connections with.

I guess that's the answer then.. I'm transferring my domains away from them. I can agree with the need to police CP. However it's not their job and they do not have the legal right to ask for ID's.

On top of that every domain should not be locked just because there was a complaint on one of them.

bye bye Directnic.. seems paying for overpriced registrations because a company has an adult history is no safer than dealing with a normal 8.99 registrar.

You know, that's a good question. I guess that it depends on how this turns out in the end. In a way, I guess they mean well, but I'm not sure about the way they're handling this.

Will he make a special exception in this case? Or will DirectNic accept the public 2257 info on their sites as proof of age?

My attorney emailed them back to offer a list of the hosted galleries with thumbs and the sponsor that goes with them to see if they'll accept that, but he also said that I should work on trying to get the documents just in case.

Others have pointed out that several other registrars have the same verbiage in their TOS. DirectNic is probably MORE adult friendly by going to the webmaster first instead of turning it over immediately to a government agency.
