Consent form to view porn at work.
A friend of mine works at an online video/music content distribution company. And they just recently purchased a company that also distributes adult content. And now their employees may be exposed to this content when that was not part of their original job. So she's looking for some kind of consent form for their employees so they don't get sued for sexual indecency / harassment or whatever might arise from this. Anyone got anything like this?

Have your friend hold a manditory meeting of all employees.
Then announce "we are now selling adult material that employees must handle and thus possibly veiw it. If this offends you then you must resign today at this very moment or you consent to these new circumstatnces. I will now give 15 minutes for all who want to resign to leave the property. Your final check will be mailed to you last address listed with the company." Not a single fucking person will get up and leave. |
Nice. I'm sure they'll have some sort of meeting like this. But I think they're really just looking to cover their asses legally. And that requires some documented proof of consent. For current and new employees. I've never heard of any cases of it becoming a legal issue. But its always good to cover your bases.

They would probably have to take steps to isolate the people working in adult content, making sure that those current employees who do not want to see porn are not forced to view it. Further, they will never be in a position to let those employees go or fire them for not wanting to look at adult content. Every job will likely have to be classed "with adult content" and "without adult content" and people assigned or re-assigned accordingly, without any punishment for those who do not want to see adult content. They should probably offer a generous package for anyone who is offended and wants to leave the company, to avoid lawsuits in the future. Good luck, that is a pretty ugly situation. |
Your friend needs to talk with a lawyer, not look for a consent form.
|
Yeah, most the employees don't have to work with the content. They just may be exposed to it inadvertently. So they really just want their employees to be made aware of it. And if anyone has a reasonable objection to being exposed to it, the special arrangements will be made to make sure they will not be exposed. Its just a small part of the profits and should not affect the daily lives of all the employees to the point where they need to leave if they are not comfortable with it.

I think they should call the FBI in to sort it out - its the only way to be sure.
Also - the CIA may be able to help. Failing that bring bush in to help out and give his opinion on this most SERIOUS of matters. Whaaa Whhaaaaaaa |

I would imagine any documentation of it all should include a 90-day period (or some respectable time-frame) from such-and-such a date where anyone can decide that they're uncomfortable and you can take the appropriate steps with them then. Meanwhile, make sure all of your new hires are cool with it all, and 90 days from now, it might not be a problem at all. |

Yeah, that sounds like the best route to go. Allow people an out if they really feel that uncomfortable because there are plenty of people that would not like dealing with this content. And I like the 90 day waiting period. Ease people into the situation. And yeah, if they are this concerned, they should consult their lawyers for a better answer. |

That happens on a daily basis: EX. New Policies: 1. Using cellphones during work is cause for termination 2. Unauthorized use of copy machine is cause for termination 3. etc.... Get off the fucking computer and get into the real world. Employers have every right in the world to get rid of your fucking ass if you don't like what they are legally doing. (illegal is another story) You don't have the right to stay in a company and bitch about it's legal activities and stir up discontent with other employees. You don't have to break the law to get fired. A big fucking mouth or "bad attitude is enough". On the other hand allowing them to actually see the porn before they make a decision is fucking suicide. |
hahahahaha....i gotta find that 15min short movie about the guy viewing at email at work with some sweet f@rm g1rl sex pics in it.....guy ends up killin himself..lol...whats the name anyone know?

Ok then here's the "nice" way (although underhanded and sleezy). Hold the meeting and announce: "We are opening a new division of the company dealing with sexualy explicit material. We are now hiring for those positions. Long lasting opportunity is forseen in these position and all who would like to apply can do so after this meeting". Then explain it all to those who apply, hire them for the positions. Hire new people under those conditions to fill the other spots. After 3 months announce the layoff of those people who are in excess in the non-adult area. |

Threating to fire people lowers moral. Which lowers productivity. Bad for the employees, bad for the company. We're all used to seeing porn. But there are people out there that get offended. If your employers told you "We're putting a giant crucifix of Jesus (or insert some other religious symbol that might offend any number of people) right over your desk. If you don't like that, then you're fired." And you were offended by this, you don't think you should have the right to either object to it or have it or you moved to another area where you can continue your job as normal without being affected? |

Final word. Forget about any advise on this board. Just run down to your local Block Buster Video and fill out an application and copy what ever they give you and use it. They sell porn and the clerk rings it up. I don't think they ever got sued. |

not porn..lol |

I never told you to fire anybody. I said to give them the option to avoid seeing the new legal material by resigning. BIG DIFFERRENCE. I think it's good the way you're trying to work things out; i'm just saying that you don't have to be so nice about it if that will move things along faster. My attitude about the situation is such because I'm sick of baby-assed whining Americans on the job bitching about things that don't matter. If I work for jews then I have no place bitching about them putting up hanukkah candles in December because I'm a christain and it offends me. This kind of stuff is just crap. It's a free country so why don't people just move on if it's such a pain instead of sueing the company for exercising it's freedom. But...you are right to try to do things the way you are going about it. |
That's a good idea since there's case law in California that deems systemic/routine exposure to adult material as part of a "hostile work environment" in a sexual harassment claim.
