He and his affiliates have been phishing myspace accounts and sending millions of bulletins.

Fuck MySpace. I would like to get a class action suit going against them for allowing their users to use copyrighted/stolen content in profiles and not doing shit about it, even after repeated emails and phonecalls.

EVERYTHING on myspace is spam. From the whores, to the tv show profiles promoting the new reality shows who get suckers watching every time and probably getting into other things at there myspace site (ring tones etc). The real problem is the people who are actually scamming and using other peoples profiles to benefit in there favor..:2 cents:

Myspace is using the strict California state anti-spam laws as basis for the punitive damages cash amount. These laws are meant for email, not bulletins, but for some reason, they are using this as the reason for the crazy damages suit.

I have a list of 6 confirmed networks and 14-17 unconfirmed networks, but will hold off on releasing the names of them until I am absolutely sure they are involved. I was debating on releasing the names, but seeing as this is one hell of a blow that will most likely kill off a network, I think it's safer to just wait a bit and see who is really on the list and who isn't.

The biggest network being hit is CPA Empire for a staggering $75 million.

I've been saying this for a while now, Myspace was actively monitoring the spam-friendly haven forum known as Screennameforum.com. The list of networks being sued reads like a shopping list, because they all, at some point or another drafted known Myspace spammers and phishers into their programs to promote their offers, even AFTER cease and desist letters were issued to them by Myspace.

It really sucks that this is happening, but at the same time, I don't blame Myspace for their actions, nor do I blame them for doing this and using the networks as an example of their anti-spam rules. This should act as a warning to the entire industry, that spam, no matter email or social networking, is probably not the best route to pursue.

But on an unrelated note, this is exactly why spamming is something I'll never do again. The money was nice yeah, but it wasn't worth living in constant fear that the next knock on my door will be the sheriff serving me with a summons.

they deserve it if you ask me. They were not just your typical spammer, but they were hacking myspace passwords (including mine) to post bulk bulletin topics. A hacked account may get involved to several illegal activities. I filled a complaint too when I saw my profile posting things that weren't mine. (dating ads).

I'll tell you what - I'm glad to fuck I didn't spam myspace - and I didnt spam blogspot either - I reckon others will follow and this is the key issue.

Blogger, Youtube and others could make serious cash taking the spammers on.

Only way to do this is host your own bloggs for those precious links - in which case you may aswell just write sites - coming full circle now.

My two cents anyway.

Well, as with any big story, there are a lot of unfounded rumours flying about. Let's dispell a few shall we...

just because someone 'said' it doesn't make it true. I assume you read that on Shoe's blog and what Jon is spouting on Wicked fire because of the numbers you are quoting.
Shoe and Jon are smart guys. I love them both. THEY also love links and attention, I mean smoochie smoochie behind the bushes looooove links and attention. BUT they are also smart.

Shoe himself is saying nothing is or isn't true, Scott naturally has many reasons to say all sorts of things at this point.
I have spoken to many network execs and am one myself. NONE of them have received anything.
You will also note that Jon quickly withdrew what he was saying.
"Removed the list. Too many what if's. Wouldn't be fair to the networks that I originally mentioned without seeing their lawsuit files. Will post the list again when everything is confirmed, in writing."

They are after Scott Richter for Bulletin Spamming
No. They are suing Scott for allegedly being complicate with and participating in Phishing schemes. I don't know what evidence they have to prove that, but good luck to them. Bulletin spamming is what they alleged happened with these phished accounts. But making use of phished accts is where they appear to be laying their cards.


That the CAN-SPAM act is being violated by anyone here.
mySpace is trying to use the CAN-SPAM act to prosecute Scott. I laugh heartily at that. The CAN-SPAM act is very specifically about unsolicited email marketing. The best thing that could come out of this is that the act is expanded to include these sorts of actions. Phishing is a big problem on the net, causing identity theft etc etc. Phishing needs to be addressed by the courts. Maybe this will help bring that about. But I reeeeally doubt Scott will get trouble. I mean they have to prove that HE did the phishing and that harm was caused by it. We are talking about mySpace logins... not bank, VISA and paypal accts. mySpace is drawing at straws on this one. Good luck to them... will probably get thrown out before it even hits the courts.

People using adder bots etc to promote their business, offers or otherwise are next.
mySpace is desperate for a target that makes them look good and is an easy win. Scott is that... an easy target. He has had previous run ins and is a known alledged spammer. CPAEmpire has deep pockets and could pay a big fine. Ipod and Polo shirt offers are harmless on the surface. People like to rally around lynching a 'spammer'.
If they REALLY wanted to stop spam they should:
Fix their crappy code
Start policing the profiles and content better.
The first step for anyone is a Cease and Desist order. If they are after YOU you'll get one of those first.

If they want to catch a bad guy, they should go after the BAD GUYS!
mySpace is FULL of ads for porn, webcams, phishing scams for paypal accts, worms and redirects that load computers with spyware/malware and create zombie networks. THOSE are the bad guys! Inundating 14 yr old kids with ads for Granny Porn and Viagra. But... that doesn't make a great headline does it?

"MySpace full of porn and spyware... They finally making futile attempt at slowing the flood."
hmmmm... maybe i won't let my 16yr old daughter visit that site anymore... sounds like a bad place.
But really THAT is the worst problem, the problem we all want to see go away.
Instead we have:
"MySpace Brings Suit to Stop Spam"
and
''MySpace sues Spam King"
much easier to get behind that...

now.. all that being said. I am NOT saying that it is ok to spam mySpace or anyone/thing else. I am just dispelling some rampant misinformation. PPL in this industry love to be Chicken Littles. And love to act like they are 'in the know'. Others like to wait until the facts are in. And they have only just begun to come in. This will be a loooong process.

My bro had it happen to him as well. The guy was sending people to a Yahoo Ads page ...about 20,000 uniques daily. The Yahoo account and page are still up after more than six months...:error
