its funny i always see conflicting reports about the legal aspect of forums/blogs/etc
this was said by their lawyer --------------- Zoeller's attorney, Scott D. Sheftall, said he filed the lawsuit against a Miami firm last week because the law won't allow him to sue St. Petersburg-based Wikipedia. ---------------- I thought we heard this had changed recently.. So gfy is not responsoble nor could they be sued if someone makes false statements about someone.. ? They would have to go after the poster directly |
I think ISPs are immune, and Wikipedia may be functioning similar to an ISP.

His attorney may not be entirely up to day on this stuff, or may be mistaking wikipedia might have ISP status. However, as Wikipedia does edit (and apply "quality control") to the material, they do bear some responsibility. It would all depend on how the react to notification. If they removed the offending post(s) as soon as notified, they may have an out.
Someone will get wiki into court one day and then we will see. |
