Update: XPays Successfully Enforces Copyright Abroad(HagueConventionTreaty+Berra.org)

There is hope for cooperation worldwide as evidenced by the fact that we brought multiple, previously unresponsive, foreign companies to the table. After valid foreign service(s) and use of all available legal remedies, settlements have been reached and future cooperation is assured.

Paul Berra of http://Berra.org continues to handle the case and has demonstrated extreme effectiveness in all aspects of the enforcements.

While it was not easy or cheap to protect our rights outside of the U.S., we will continue to ensure that XPays is clear of dilution of our intellectual property rights. XPays encourages other copyright holders to do the same.

XPays appreciates the cooperation of those involved, Verotel and Adult Profit, & we look forward to respecting each other's rights going forward.

I don't think you have truly made it in life until you use "going forward" in a sentence so congratz. You now join the likes of fortune 500 CEO's and especially US Commanders in Iraq when they talk about how the war will be better next year. :thumbsup

every industry has politics within it. :2 cents:

I'm just sick of the shady shit going on in this biz. Why should somebody profit off something that you worked to get the rights to? They can't handle getting the money by going through xpays in a legit way? Fuck em' It's time to start fighting thieves and file sharing sites and all our ratios will go up. That's just a fact.

Well I have to give you credit for going after the content infringer's. I'm just not a fan of the trade mark stuff.

I think trade marks and patents have killed innovation in this day and age, and I'm a firm believer that common words or phrases should not be able to be trademarked.

Maybe you guys can get Lars to kick in on the legal fees because I'm sure the torrent site is advertising AFF and Cams ads.. :1orglaugh

We just had two new trademark infringers pop up... are Berra's rates reasonable? Our current legal has always gotten the job done but i would love to do the same for less...

Congrats btw!

hi far-l - email sent and Paul is very reasonable. The key to our current success with Paul running the show is that he is efficient. So you can expect his efficiency do keep costs reasonable.

Thanks and you are not alone in your concerns about the connection between ip and innovation. We feel that patent and trademark reform is not a bad thing; but, overall, ip law is what allows companies to benefit from their own legitimate innovations.

You cannot trademark common words and phrases... but you can take action against confusion of trademarked words and phrases...

For example, we have the trademark "Homegrown Video". We could not trademark the term "homegrown" by itself but we can go after anyone that uses Homegrown + another word or phrase that describes anything adult entertainment related. So, for instance, we can't go after something like "homegrowntomatoes.com" but we can and do go after things like "homegrowncuties.com" or "homegrownamateursex.com".

Respectfully, I don't understand why you or anyone else would have a problem with that.

germ 03-20-2007 04:06 PM

congratulations. its good to see someone properly handling their business. :thumbsup

Seriously, Evan when will you share with us all the patents you hold.

From what I hear everyone here is violating your patents. Why wont you tell us what there are?

Why patent something we are all using if you don't plan on pulling an acacia sooner or later.

XPays 03-20-2007 05:08 PM

you should sign up for http://IPalert.com Will and monitor our Patents and others whom you have a hardon for :thumbsup

We have patents pending and i guarantee we are never going to be an acacia... patents can also be applied defensively...

we have some good resources at the major portals and other places where exclusive content owners can cut off infringement. get a hold of me if anyone needs assistance :2 cents:

for you bubby and since we landed both wires in the original post :winkwink: , here you go, foreign companies ducked us and ducked service both digitally and physical. we dmca'd them out of every worthwhile traffic source, hired a private investigator, had some help from Franck serving verotel, default judgement in hand on adultprofit and once we were going to have a ticket to go after assets to satisfy the judgement, magically some entities came to the table. the key thing is avoiding future infringement and cooperation in the future should there be an issue..... there is way more to the story but it will give us something to talk about over a bagel next time i'm in nyc.

we will take any case the distance that cannot be resolved btw. we will attempt to set precedent regarding "review" sites who charge 30$/month and use content without consent for starters.

How can i have a hardon for your patents when I don't know what the fuck they are.

Why should I have to signup for something to find out ? Why can't you answer the question instead of being a dick. I hear that almost everyone here violates your patents, but I don't believe everything I hear so I have made more than one post asking you what your patents. You ignored me and now direct me to some service to sign up to. Why don't you just answer the question ???

I think it is great you protect your content. But I have also seen where you threaten to sue people with domain names like sexpays.com because you think it infringes on xpays. You have proven to be extemely sue happy and when I hear you own a bunch of patents that we are all violating do you mind if i fucking ask you what they are ?

patents can be great. I have a couple things I am working on right now that I would like to patent and when it is done I probably will. It is a process that no one else is doing and once it is released I am sure it would be copied.

But then there are people like acacia who have bullshit patents, and try to scare people into paying them.

Isn't the purpose of a patent, to prevent others from copying you and to discourage people from even trying in the first place.

Why keep it a secret ? If you trying to protect something why not let people know up front it is patented. The only reason I can understand why people are reluctant to disclose their patents is because the want people to use them so they can wait for a big pay day and cash in on licensing. Wait till people are dependant on them and it cost them to much to find another way, where as if they knew up front they would have found a different way from the start.

I am not talking about shit like if you patented something like the " baconwave " for microwaving bacon. Who here cares about that, but from what I hear you have patents that most of us are using. So why wont you share them then ?

Calvinguy 03-22-2007 11:25 PM

I have a word mark that is registered as 'SUPPLEMENTAL' and the mark drawing code is '(4) STANDARD CHARACTER MARK'.

Do I have any privileges other than having my word mark reserved?
