Gonzales Confirms Bogden Was Fired Over Lack Of Obscenity Cases

WASHINGTON - In testimony before the Senate Judiciary Committee today, Attorney General Alberto Gonzales confirmed that the United States Attorney for the District of Nevada, Daniel Bogden, was fired for failing to bring any obscenity cases, although pressured to do so by Brent Ward, head of the Justice Department's Obscenity Prosecution Task Force.

Under questioning from Sen. Sam Brownback, the administration's main congressional proponent for destruction of the adult industry, Gonzales answered a query about the reasons for Bogden's firing that there were concerns about "the energy in [Bogden's] department in this fast-growing district" and about the lack of any obscenity prosecutions. No other reasons were given for Bogden's firing, and Brownback repeated the "obscenity" justification in his summary at the end of his allotted time for questions.

And since the entire purpose of the Judiciary Committee's investigation is to find out whether eight U.S. Attorneys (USAs) from various districts around the country were fired for "political reasons," it would seem that Gonzales' statement has just made their case for them, since few policies have been more politically charged in the Bush administration than advancing the religious right's obsession with stamping out all forms of sexually explicit expression.

The only news is that they fired US Attorney's who did not think porn prosecutions were a prudent use of resources. Guess what the message to the remaining US Attorneys might be?
For those who remember Janet Reno, she thought there were more important things to worry about. Even Ashcroft never pushed the issue, this guy, Gonzales is making porn prosecutions a priority just like torture.

I love the morality of these people, porn is bad, torture is good.

They are being push by the crotch Christians they only care about porn, not the hungry or poor health care or troops dying but porn is a big evil.He wanted people off of CP cases thats fucking criminal.

I think that many prosecutors are not interested in pressing obscenity cases (especially in more liberal states) because there is little or no upside. The amount of effort required to set up an obscenity case can be pretty big, and there is a fair to middling chance each time that they lose and another set the bar higher for the next case.

They don't want to push marginal cases - they want slam dunk certain cases, preferably ones that can be negotiated out of court and moved along. I think everyone is seeing what has happened with Lizzie Borden at al, and realize that obscenity prosecutions are usually long, require plenty of manpower, and can take forever to move along.

Combined with the grey areas of 2257 and other issues related to online porn, I think the prosecutors have been right to wait a bit and get things settled before moving forward.


Gonzales on the other hand has a short window to push the conservative agenda forward. With only the potential of 4 years in the job, he has to move quickly. His testimony today makes it very clear that he isn't working to apply the law, but rather attempting to use the law to push a political agenda, which is very, very wrong.

Americans should be way more upset.

Yes, but you have to look just behind him to realize that people like Cheney and Rove had their hand up his ass playing puppet with them. At this point, he is a dead duck, another token "take down" to avoid getting Rove in any trouble. The reality is that the democrats aren't going to let up on all the missing emails, and soon enough the shit will hit the fan even harder.

I think it only about 50/50 that Bush makes it to the end of his term.
