In '91 I got a DUI. The sentence was 1 year probation, and a 1 year license supension. I ignored the suspension.

I'm a REALLY shitty driver, so I got pulled over for speeding 3 times in that year. The first two times I got a $150 dollar TICKET for driving while suspended, the third time they just gave me a summons for a B misdemeanor DWS.

At no time was I arrested. The sentence for the final DWS was 90 more days of suspension, and court costs.

I didn't even have a lawyer.

I was put on probation first, but the fuckin lady said I did not have a "real job" and she said I had to get one and attend AA. I told her to fuck off :)

There are fucking violent felons in Cali and all over this country getting early release and/or house arrest. If that judge had ANY sense he'd have stuck her on house arrest in the first place.

State DUI laws are for the most part much more harsh these days than back in 91' Also, Paris got 2 DUI, in your scenario you only had 1 despite the other traffic violations. She needs to do her time and put it behind her, but I have little faith it will alter her lifestyle.

I do agree that this circus is out of control, bitch should do her time and stfu. My issue is only that she even got the time in the first place.

the judge purposely gave her the jail time to teach celebs a lesson. the sheriffs office fucked up his idea. thats what really happened.

This would be my number ONE concern if I worked for the sheriff's office. This bitch has the money and the right people to drop a multi million dollar bitchslap on anyone at a moments notice. Think of all the things she could "try" to sue on:

Unclean enviornment
Unacceptable food
Lack of Excercise
Lack of medical treatment options
Rape
Any other sexual assault

...and the list goes on. The catch is, the common criminal doesn't have the financial backing to sue on any of this. Can you imagine the number of tine mistakes made daily in a prision that were not 100% by the book? All she has to do is CLAIM one....

I heard she was in a cell by herself. Suing for rape might be hard :)

I read she shared a cell with one other person. In addition to that, she could very well just make the claim that someone made sexual advances to her; including the guards.

Having been cited and gone through the legal system in both CA and IN I can assure you that there is not much that the two states have in common.

She is the one that wanted to go to special needs. If she has a lack of exercise that is her problem

My uncle got caught for DUI - then driving with a suspended licence under influence of pot and put in jail for almost 3 months....so it's possible.

Somebody please explain to me how another's "worse" crime has any bearing at all on what a separate individual should be punished for? I never understand that rationale.

Where I live, If that was her second dui she would have gotten 90 days with 75 suspended as long as she remains law abiding for 1 year. If she would have been caught driving on suspension in that 1 year the judge would fine her and make her serve the 75 days he suspended.

The first time she was busted on probation, she was reportedly told that her offense merited jail time, but the judge would let her off easy - that time... you weren't.

The chick shows a blatant disregard for the law, and made it pretty obvious that she feels she's above it all.

A reality check's in order, imho. I think she got exactly what she deserved in the initial sentencing.



In this recent drama, however, I do kinda sympathize for her. The sheriff's a schmuck for creating the situation out of his inflated sense of self-worth.

She did not have two DUI's and in fact I think she was not actually convicted for a single DUI (though she may have been) but plead guilty to reckless driving.

She did not recieve a slap on the wrist in the first place. She recieved what an average person would recieve for a first offense. It is not infrequent for a person to be let out of jail to serve house arrest for many different reasons including medical reasons. So you are wrong.

We have this thing called constitutional cgovernment in the U.S. It's the job of the judiciary to interpret law. It's the job of the executive (e.g. the sheriff's office) to execute those interpretations. The Sheriff has the power to release inmates from his jail for many different reasons and he exercises that power virtually every day. It is SOP to the point that he does not normally file with the court, as he is technically required to do. Normally Judges do not interrfer with the power of the Sheriff as this Judge has.

I will not be surprised to see the Sheriff file the proper paper work with the court and she will be released to house arrest once again.

By the way she only had to do 23 days until she decided to suck off the sherriff to get released after 3 days.

And an where I live if you violate your probation you get a minimum of 30 days and typically up to a year.

my wife had 2 DUI's, the 2nd one while she was on probation.

I'm torn on the issue. She is clearly being given a tougher penalty than others in that position. The judge is trying to make an example out of her. While I don't have a problem with people who commit the crimes she has getting a taste of the slammer, I think it should be universal to all who do the same thing.

But in the other sense, she has been treated better than most inmates. She got a private room, was given a buzzer to alert guards whenever she felt threatened, and was given very liberal use of the phone. If it was us in that prison, we'd be randomly thrown in with someone and the guards would laugh in our face if we told them we didn't like the food and couldn't sleep. We certainly wouldn't have been sent home for this.

But I wish she'd just shut the fuck up and serve her time. She acts like she's being thrown into some Turkish prison with a group of hungry bull-dykes. She's in solitary, gets 3 square meals, and doesn't have to deal with the shit most people in prison do. So pick up a book and read for a couple weeks. There are a lot of people in this world who are in shittier situations and dont' have a fucking nervous breakdown over it.

Where you live the jails aren't as crowded as LA. I think it sucks too to be let out with only serving 5% of your sentence, but that's how LA works these days for non-violent offenders. They send a lot of people home after a few hours even. It's not the sheriffs fault, they need a lot more jails.

I don't care about Paris getting "unfair time" any more than I care about Jerome getting "unfair time" for hitting Rick with a brick.

I'll admit that I had interest in this before the recent hijinks - due to the fact that she was pulled over on a street that my girlfriend drives home on every night...

But most recently I'm interested in it all because of the constitutional facets of the case and how the executive overstepped its constitutional bounds - which seems to be a trend in our country as of late.

are you in cali? if not maybe their laws are more strict than where you are... here in nc the 2nd dui you have 30 days jail time and you lose your license for 4 yrs with no limited driving privilege at all.. i dont know what happens if you get any more than that!

I'm fine with her on home arrest. BUT I think she should do it for TWICE AS LONG AS SHE WOULD HAVE IN NORMAL JAIL. Thats a fair trade-off for a non-violent crime.
