2257 forms and model releases
 
Where would I find the Best and most up to date 2257 and model release forms?
I have been using a generic release my lawyer typed up aswell as the 2257 doc from freespeach but there must be a more detailed or extensive set of forms to have filled out when shooting content?
Do you have to have seperate forms for video and photo?
I have a bunch of exclusive content I want to market right away but in canada the paperwork is very relaxed and i need to be at par with the US regulations...... and my lawyer isnt much help there.

once i have the paperwork needed Ill have all kinds of samples to post ;)

If you are producing content in Canada I would be careful. Canada has very strict privacy laws that are different from the US and are not considered in the FSC's model release and 2257 docs. I know cause I was one of the authors of their releases.

Talk to an attorney that knows EU privacy laws and the safe harbor provisions. Dont use forms in this case.

Can you reccomend a good lawyer that deals with this stuff directly? Becuse Ive called the canadian lawyer refferal network and they came up with nothing.

This is nuts.
Everywhere i read The 2257 doc, 2 gov ID's scanned and filled on form and a standard model release with witness signed is ample for covering ones butt.
Is this not the case?

Not legal advice.

Something along the lines of
2 ID's
Picture of them holding those ID's next to face.
Form that lists their real name, married name, and any aliases or stage names used, can be incorperated into another form.
Form that lists the date of production, can be incorperated into another form.
Maybe a clause that gives you the right to share an edited ID with the users of the material. Such editing would only leave the name and date of birth. Sort of a privacy waiver.
Then a real solid model release.

Where in Alberta are you from?

You have to be careful because of the Privacy Act here. A general release and single form of ID is all thats needed in Canada.
Complying with the US 2257 in Canada can land you in jail. Selling the content to an American... well call a lawyer. I can get you the name of the guy I use, but expect a 400 dollar bill just for his secretary to transfer your call to him.

Quentin, I called him and am waiting for a call back.

I find it odd that there are so many people that deal with this everyday but no one knows what to do? Ive got a bunch of content to sell and lots invested in it. The models are close by and will fix up any paperwork if needed..... I just need to know what that may be???

It is suggested that you should ask them these questions and videotape it so no one can come along later and say you forced them into it.

It's true about 2257. It's not a Canadian law and by complying with it you are breaking Canadian PITA laws. Lawyer is your safest bet.

When doing video I also (just to cover my ass) have them record the same text spoken as on the release form and show id on cam....

There's no such thing as being paranoid. Models are unstable individuals. You can either have your ass properly covered or you are looking at some serious issues that are going to happen down the road and might ruin your life completely. Protect yourself and avoid drama. We are subject to Dutch Laws and EU directives that are of a similar issue ...
