Wish I could make it. I'm hitting both AEE and InterNext, but I'm leaving Vegas on Monday since I have biz in the Bay Area on Tuesday.

I attended the first conference, and it was truly inspiring. Jason is very passionate about this issue, as I am sure the others on the panel are, so I'm sure it will be well worth attending, both for getting info and sharing ideas.

fair use does not end at what is explicitly defined in the act itself

backup is a fair use right
recovery is a fair use right
time shifting is a fair use right
format shifting is a fair use right

and none of them are defined explictly in the act

ignoring all of these fair use rights and pretending all of these legitimate fair uses are theft is exactly the type of bullshit i am talking about it.

Include the right of recover and backup and even 99% of the people are
actually downloading the content without purchasing a right to it a torrent is 50% +1 non infringing act.

90% used torrents to get a tv show they missed on traditional tv.
only 10% were using it to get access to content they never paid for.

if i were to for example purchase 3 day pass to milfhunter.com
i have purchased a right to view 10,000+ hours of content.
recovering any of the content i purchased a right to view falls in the same legal area as recovering a "stargate Atlantis" i forgot to tape on friday night.

but if you have an independent research study that disputes that i would love to see it.

but so far this is just another example of the abuse of fair use.

well it the only independent research i can point to (using statistical sampling rules the number could be agregated to other markets - like adult content)

i haven't seen a single independent study or report for the adult industry, and if the numbers were as great in the case of infringing use (99.999999%) using services like the company i am a partner in you would be able to slow the torrent speed to a crawl by sending connection termination request to the isps of the infringing users.

It not that hard to solve the problem without targeting those who are using the torrents as a legitimate recovery/backup solution.



The fact is given the liciencing of content (videos licienced to multiple sites), the multiple format streams (VCR, DVD, Ipod, etc), and shear volume of content you are selling a right to view with 3 day trials. I would suspect the amount of case law defined fair use (betamax case, rio case, decss, etc) the percentages are even higher.

but again i could be wrong, just point me to the independent research study that proves that 99.99999999% of adult torrent traffic never purchased any right to the content.
