I own the domain GayTube.com. I've owned it since 2005. As the owner of the domain I take responsibility for what happens on the site. I admit that I have been negligent in that regard lately. I haven't paid attention to what was going on. I handed it over to two of my employees to run and focused my attention on bigger matters.

Last week I got the bandwidth bill for the site and you can be sure as hell I took notice. I met with my guys running the site and made sure my intentions were clear. I told them that I am OK with it being a user submitted site but under NO circumstances is there to be any stolen content on the site. I told them if any copyrighted videos are found, they are to be removed immediately and without question.

The site does not have any stolen content on it now. It is 100% clean and will remain that way. Was it 100% clean a week ago? Regretfully, no it wasn't. I did not authorize it but ultimately I take full responsibility for it.

Hey, if you will work to make sure it does not happen in the future and not have any other such dealings then this is good enough for me. I'm not sure what more we can ask. At least you appear to be making a commitment to do the right thing from here on out.

Oh I also forgot that all that stolen content helped you jump in traffic rankings... Now you can take them off of course. Same approach worked for xtube too.

If there is nothing wrong with the site why did you change the whois to show that it's now owned by Frappers Investments and based out of Nassau? Did your lawyers tell you that would be better than being based out of Toronto like it was the other day?

Regardless of what Directnic shows GayTube domain and trademark were never canadian. the whois was inaccurate a few days ago. When the boys started up the site as a user submitted site I knew the potential for trouble was high so i changed the directnic info. Had I known how to set it to private i would have.

We've taken note of the companies that had stolen content on the site and will be flying their banners (with no affiliate code) to make up for their content being misused.

isn't every video clip, no matter how long or short, protected by copyright? I don't understand the if it's protected by copyright we don't use it. All works are automatically protected by copyright law.

If people are submitting content other than sponsors, (user submits) of course its going to be illegal,

You need to disable that, or at least hand approve all submits so you can add the proper affil codes.

It's whether or not you have the rights to use that copyrighed material that's the issue.

So it was a mistake to have your own info on a domain you own? Why switch it to somebody else and not have it under carsed marketing where it's trademarked under? Seems like a shell game to me. Not to mention isn't it true that with Canada's increasingly tougher piracy laws it's a lot better for you to switch it to a Nassau based where their piracy laws are a joke. Seems very shady to me and nice to know your only real regret here is that you didn't know how to make the domain info private.
