This just in from Seattle -- Impulse Media, better known to most as Soul Cash, has triumphed in its CAN-SPAM case. The jury returned its unanimous verdict earlier this afternoon. Read the (very brief) article about this development on XBIZ here.

I give serious props to Seth for having the where with all to go the distance and tackle this head on. And of course, Rob and Spencers legal skills. It takes a certain type to go toe to toe on cases like this and the end result is that we will all benefit from their work.

wow..talk about a david vs. goliath case. Impulse Media was the ONLY company to fight the government while the other companies settled.This case will set a HUGE precedent in the industry and will be felt for years to come.Godspeed Seth!

This case with the FTC has been going on for 4 years and we finally won! In the process it's ruined SoulCash beyond repair because 4 Webmasters felt like abusing the program.

I had to make the decision to stand up and fight, or lay down and take it in the ass. Unfortuneatly for the DOJ they didn't realize that I see it as a problem with the way the US Government thinks they can walk in to our industry and feed us a shit sandwich and expect us to eat it.

To SoulCash webmasters... I used to be one of the golden boys (if a brotha can do that) of the adult industry. The last couple of years I've been laying low doing what I had to do to survive and fight. I was guilty of sticking my head in the sand at times instead of communicating what's been going on. There's mud on my name but I'll do whatever I can to make shit right. I had to make a decision to kill the program and pursue this case. Along the way payouts have been missed and my webmasters are owed money. Most have had patience and understanding, while others flamed me. Fighting the FTC is a decision I made, and I'll try and get everybody owed money paid pronto.

If you're pissed off about not being paid... gain solice in the fact that the million dollar business I built from scratch is gone. All I hope is it does some other companys some good.

In the mean time the result of this case will allow adult programs to operate in the US with a little more comfort than before. Major props to Carpe Law, Rob Apgood, and Spencer (ARE YOU KHIIDING ME?) Freeman for bringing the ruckus to the FTC and the DOJ!

It's really sad that it has cost you a fortune, your business, and your reputation, but I think all of that will be back again soon!

just read in a NY newspaper what cyberheat agreed to in their settlement:




Earlier this month Cyberheat settled a similar case with the FTC. The porn marketer agree to pay $413,000 and abide by some pretty tight restrictions on its affiliate marketing program including to:

*Contractually require its affiliates to identify any subaffiliates they intend to use.

*Provide each affiliate a copy of the FTC’s order.

*Get a written agreement from each affiliate to comply with the order and the Can Spam Act.

*Contractually require each affiliate that intends to use e-mail marketing to provide Cyberheat the e-mail address from which the campaign will be sent, the subject line, the dates the e-mail will be sent, the e-mail addresses to which the e-mail will be sent, and a certification regarding how the addresses were gathered, all at least seven days before the campaign.

*Review each affiliate’s e-mail campaign for compliance with the Can Spam Act at least three days before the campaign and certify in writing it has done so.

*Require each consumer who signs up for Cyberheat’s services to indicate how they heard of the company. If they heard of it through e-mail, Cyberheat has agreed to monitor the affiliate that sent the e-mail for compliance with Can Spam.

The Cyberheat case was seen by experts as an example of the FTC being increasingly skeptical of marketers claiming they aren’t aware of affiliate spamming.
