Government gets rehearing in 2257 case
The 6th Circuit U.S. Court of Appeals issued an order today granting the government an en banc rehearing of the Connection Distributing case -- that's the case in which a panel from from the 6th Circuit declared 2257 unconstitutional.
I've posted an article about this on XBIZ, with comment from a few adult industry attorneys. - Q. |
Round number... um, what round are we in again?
|
If they stopped the storm trooper tactics, and worked with us, instead of trying to put us in jail, then they would get a lot farther and waste a lot less money.

I can't put your daughter on my website but you can send her off to war and kill her.
|
It makes perfect sense that our goverment that cant run an economy, war on terror, or a war on drugs cant even set up a standard policy for a HUGE industry. Fucking lame.

only a few responses?

2257 is a waste. It's so easy for kids to get a fake ID that it's no longer funny.
|
Cool, if the entire 6th circuit declares it unconstitutional (and I have no reason to believe that they won't) then that should put this whole statute back into the cereal box it came in for awhile.

The odds are that by the time the en banc decision comes down, whether it's for us or against us, there will be a new administration in transition. This isn't going to be a priority for the new administration regardless of who wins in November. McCain has never been one to kowtow to the religious right, and I don't think he's going to....especially since he'll likely only serve one term and won't need their votes to get re-elected. I definitely don't think harassing us is going to be a priority for a democratic administration either. PLUS, if we win in court, which I think is likely, then that means the entire statute is overly-broad and needs to be rewritten....and that's not going to be a priority for a democrat controlled congress......AND if or when a new statute is written, in order to not be overly broad, it will likely have to be limited to commercial producers AND primary producers....which will take the burden off of most of us :2 cents: |
man there is some bold confidence in this thread. I hope you are right.

Don't think many webmasters are surprised by this. I think what will most likely happen is the government will eventually attack from a different angle (ie pass bills to regulate/profit vs demolishing the industry.) Regardless, it's far from over.
Thanks for the update, Quentin. Mr. Pinks: What happened regarding Evil Angel? |
That's cool.

However, if they did they'd also have to go back to being, you know, public servants. You find me a cop that understands he's a sort of schoolteacher/mailman/garbage guy. |
Don't get so high on McCain. Have you considered if he really does choose Huckabee as VP? He already said he is on the list of potential VPs. If he does, this industry will be a high priority.
