today my neighbour tells me I am not allowed to work from home and have an office because this is a residental area

wtf.. am I missing something? or is she just full shit?

I tell her even on my taxes I say I work at home, and claim my office space..

Generally cities only throw a fit about a home-based business if you create too much traffic in your neighborhood. Check local laws and then tell your neighbor to eat shit.

If you are running a business out of a home you can run afoul of zoning laws. You should never tell your neighbors anything about yourself or your business. If I was you I would casually mention the next time you talk to the guy that he got the wrong impression from your conversation and that you DO have an office outside the home somewhere nearby (even if that is bullshit), and that you just have a private office at home to do your bills or some shit. Otherwise this guy now has something over on you if you are running a business out of your home and he can make trouble for you if you ever get into a beef with him.

there isn't anything wrong or illegal with a home office. The only problem is if you have employees coming into your home to work or clients coming and going frequently.

Zoning laws are for examples like so...

You have an office at home and you have multiple clients that come and go which create parking issues and these clients can come by at a walk in basis. So you are a pet groomer and people are constantly coming and going. No appointments and you could feasibly have 10 clients at one time.

Another example. You do welding work and it requires the use of loud machinery. You store chemicals that require commercial zoning, etc...

I have a "corporate" office and an office in my home and I have clients stop by here all the time at my house. We've signed deals here, had a few beers, BBQ, etc.

To my neighbors - its just my friends stopping over ... little do they know that contracts are getting inked and Statements of work / Builds of Materials for IT projects are getting done and really its not their business anyways.

You can declare any room or space in your house as an "office" for crissake. Just slap a desk and and computer in there and maybe a phone and fax if you need them, and get busy. I don't know of any residential zoning law anywhere that prohibits someone from working from home, people have been doing it since before Amway and Mary Kay and Avon and fucking Fuller Brushes.

I used to do bikini & lingerie and softcore shoots in my home years ago, no law against that either that I'm aware of. I have never heard of any law against using a camera or taking video in one's own home.

And the best part is you get to claim a % of your utilities and all your "office expenditures" on your income tax as a write-off.

I say again, your neighbor is an idiot. A nosey misinformed overbearing idiot. Do like others have said... contact your city hall, maybe get them to print you off a copy of the actual laws governing home-based businesses in your community, and go drop it in her mailbox. (or walk up and thumbtack it to her forehead)

Prob different in the states but here if you register a business name and the place of business is your home address you need to get Development Approval from the local government. I applied for an exemption and got it because i was just working on a pc.

In Montreal, if you have an office ( to earn a living ) at home, you need to apply for an " occupancy permit " . The city limits the usage to no more then 33% of the habitable space.
They charge a one-time fee . You must post the permit in your office.

This permit not given for all type of business, but those that will not create excess traffic , noise, or risk .

If you want to have a doctor's cabiner, forget it ...
