penalties shouldn't be harsh as that for some simple internet crimes unless there is a fraud

Its stupid. Child molesters and rapists who destroy lives serve way less time. Yet sending out annoying emails will get you locked up longer than most murderers get. Something ain't right.

Well his sentance does include 37 more counts, including wire fraud, money laundering and aggravated identity theft plus tax issues so its not just for his spamming :(

Granted I think 20 is ridiculous, but spamming is typically fraud. These spammers use trojaned machines to send their e-mails. That's what proxie mailing is. Using open proxies (ie PC's infected with trojans) to send their e-mail so they can't be blocked or hopefully caught.

They typically don't report their earnings or they launder the money through other means. That's how the govt always nails these guys.
