Copyright infringers argued that they shouldn't be charged with copyright infringement because the bootlegged copies of the DVDs that they were selling from most of the top porn companies....were illegal to have in Australia in the first place...and because it was illegal in Australia, it wasn't entitled to copyright protection.

Jeeeez, you never know what's going on in the mind of a thief!
