Man on eBay is sued by seller after posting 'negative feedback'

When Chris Read bought a mobile phone through online auction site eBay, it was described as being in good condition.

But when it arrived a few days later, he was disappointed to find it was not only damaged but also the wrong model.

After returning his purchase and receiving a refund from the seller, Joel Jones, he used the website's feedback section - which can be read by other people - to give his honest opinion of the transaction.

'Item was scratched, chipped and not the model advertised on Mr Jones' eBay account,' he wrote, assuming it was the end of the matter.

But in what is believed to be a legal first in the UK if the case is brought to court, he has now received an email threatening him with legal action for libel.

Mr Jones claims the unfavourable comments have damaged his business's reputation and affected trade.

The legal missive goes on to warn Mr Read that if he fails to retract his comments he will be dragged to court where he faces costs, lawyers' fees and damages.

Father-of-five Mr Read said yesterday: 'I can't believe someone can be so petty. I only wanted to buy a phone.'

Just retarded if you can't leave a realistic comment........

DAMNMAN 10-23-2008 11:08 AM

If I were ebay I'd put a clause in the contract to aviod this and freeze the sellers account.

Deej 10-23-2008 11:34 AM

hrmmm - i assume he didnt get pictures of its condition when it arrived. Should still be easy to prove he was not spewing libel, but the truth...

pornguy 10-23-2008 11:40 AM

Bojangles 10-23-2008 11:43 AM

Yup.

I remember getting notice from ebay over the summer that sellers can no longer leave negative feedback on buyers or something to that degree.

Kinda makes sense, but these ebayers have lost their minds. I only use it when I am looking for rare items, golf gears, or whatever. Maybe a dozen times a year if that.

DefaultMan 10-23-2008 11:45 AM

Some people are fucking insane.

AlienQ - BANNED FOR LIFE 10-23-2008 11:47 AM

I know someone that does nothing but Ebay for a living. EBay has been doing some very fucked up things lately to buyers and sellers.

One of them is the feedback system where comments that are made effect the ranking of items for sale. The idea was to keep bad sellers down the list and good sellers at the top. However even 1 singular negative comments will kill ranking for an item.

Thus a dearth of the bigger stores buy items from independent sellers then put in negative feedback with the sole reason to put dents on other sellers reputations.

Ebay also raised the prices they take on items sold. There is alot of weird shit going on over there these days. This artical does not surprise me because it is precisely why Seller's are raging pissed about the new feedback system.

It wouldnt surprise me if that git behind the desk sells on EBay also and sells Cell Phones and bought an item to damage the reputation of a competitor.

99% of people that say "I sue you" don't sue

Vicious_B 10-23-2008 12:08 PM

People are way too litigation happy anymore.

Here's the feedback page...

For those of you not ebay members:

Feedback / Item From / Price Date/Time

How is this worth writing a news story over... or posting here.
I could send you a similar e-mail right now...

UNINTERESTING and a misleading title. He hasn't been sued.

Spunky 10-23-2008 04:43 PM

It's all about the feedback

tony286 10-23-2008 04:51 PM

Ebay should make that it if you agree to sell or buy you have to go thru ebay arbitration. It will cut the bullshit.

cherrylula 10-23-2008 05:02 PM

Maybe it was the model advertised and this guy is just a douche.

That is the comment that will fuck up his biz, item misrepresentation. If he didn't sell the guy the wrong item, and the guy is just stupid and complaining, the other guy has a right to do something about it if he is losing $.

Ebay has sucked for years. And you cannot leave negative feedback to buyers if they fuck you over now either.

yeah well they own paypal, and we know how they handle things. :1orglaugh

NinjaSteve 10-23-2008 05:28 PM

I don't think that's something to sue over. Maybe the seller shouldn't have fucked up in the first place.

collegeboobies 10-23-2008 05:34 PM

In the United States you can sue for $5000 in small claims court, if the person that left negative feedback does not show up, you get the judgment and the feedback removed by Ebay. This is necessary now. Sellers can no longer give a buyer negative feedback, and buyers extorting sellers over feedback is now common. Many Ebay sellers sue for every single negative feedback left, even neutral. And guess what? They have perfect feedback.

Sly 10-23-2008 05:38 PM

I just bought a phone off eBay the other day, I have not received it yet. But, after I ordered it I got an e-mail from the seller basically demanding that I only give him all ratings of five. And if I don't feel like every topic deserves a five, I should e-mail him so he can rectify it.

What the hell? I'm supposed to e-mail this guy if I feel that he should get a four instead of a five?

SuckOnThis 10-23-2008 05:40 PM

Some asshole left me negative feedback 3 hours after buying (a cell phone nonetheless) from me because I didnt respond to his email right away. I accidentally sent him an old piece of crap phone that was 5 years old. Ooops.

good point :thumbsup

~Ray 10-23-2008 06:53 PM

I had a seller leave negative feedback 6 hours after the end of the auction for NON PAYMENT... 6 fucking hours after the auction ended..

Needless to say, ebay removed it.. but goes to show you what kind of horrible people are on eBay RIGHT NOW!

HeadPimp 10-23-2008 06:57 PM

eBay is dicked anyway. A lot of sellers left this year when the instituted their new policy of not letting sellers leave feedback for buyers, and pretty much always siding with buyers when it came to refunds (unless there was eBay insurance on the deal.)

Ebay is slowly dying.....

Slick 10-23-2008 06:58 PM

The thing is that the seller DID give the guy a full refund. Even though it was the wrong model and damaged. If the seller was trying to fuck him, he wouldn't have given him a refund, but he did. I wouldn't leave negative feedback for something like that.

You do know he can leave a followup feedback comment telling everyone of this, right?

You can sue for $500, much less than 5k actually.

I won a case in small claims for about $1,200.00, but then you have to chase the broke ass person for the money.

Stuck a private investigator up his ass, with a judgment they can go for their bank account, and then a 30 day hold on the money through some state legal department and 30% cut to the PI, I got paid.

So after chasing the guy, and paying someone to get the money, I surely didn't make a profit.

People are fucking losers!

This thread makes me never want to deal with ebay again. I have some crap laying around the house I was going to list too.
