The Homeless Kid From American Idol Getting Sued..

Quote:

Josiah Leming, the teary homeless singer who was the last to be axed before the top 24 round on American Idol Season 7, is facing an Idol threat in regards to his upcoming album.

According to The New York Post, Simon Fuller's 19 Entertainment, the force behind Idol, is threatening to block the release of Leming's debut disc, due in January, citing violation of terms of agreement. Leming, like all contestants, signed a strict contract with 19E that stipulates he must record with the Idol-handpicked label, Sony/BMG, and gives the company exclusive right of refusal for management and merchandising.

Leming, 19, signed with Warner Bros. earlier this year.

"Josiah was the only Idol contestant ever to get a record deal who didn't make the top 24, and one of only four contestants to get a deal this year," a rep for the 19-year-old said. "He has personal reasons for getting his music out, threat or not."

His tug-at-your-heartstrings backstory was well-chronicled on Idol - he lived in his car and his mom has terminal cancer - Leming is determined to get his album on shelves "while [his mother] is alive to share it."

Idol producers have yet to respond to Leming's lawyers, his rep said.

Should Leming be allowed to release his album? Is Idol's contract completely out of hand?

i feel sorry for people in the music industry..

Sucks for the kid. With his particular personal story/circumstances it'd be nice to see a big corp. lawyer be cool.

Why would Warner even sign him? They must have known, or at least thought they should check it out.
I mean, I'm not even in the music industry and even I could figure out that they'd already be under some sort of contract just to be a part of American Idol.

would Warner be liable for anything? wouldn't it just be the kid's problem? They will get a ton of publicity for sure

Fuck the music industry.

mizmiz 10-31-2008 10:52 AM

gj for the kid for signing a contract

Doctor Dre 10-31-2008 11:09 AM

He'll probably be able to get out of the suit if he can prove that idol wouldn't have released him. I know of at least 2 precedents where a non compete contract has been invalid because it was preventing the person from making a living.

TubeTitans_SusieQ 10-31-2008 11:22 AM

Aw that sucks :(

okfling 10-31-2008 11:24 AM

he was not bad, but just cried to much

SykkBoy 10-31-2008 12:04 PM

He was actually one of the few I liked early on...he was definitely green and raw, but had the potential to be shaped and molded into a pretty decent entertainer...

a lot of these kids sign contracts and have no clue what they are in for...

the music business is much more corrupt and fucked up than the porn business, that's for sure...

uno 10-31-2008 12:14 PM

Didn't William Hung also get a recording dead and he wasn't in the top 24.

Joe BrainCash 10-31-2008 12:24 PM

Simon Cowell's fullof shit. Yes the contract is legal but this kid's story is special...would he promote the album if Warner decides not to go ahead?

D Ghost 10-31-2008 12:26 PM

Fuck "19 Entertainment", bunch of cronies, trying to keep a good person down. This will probably be the only album from anyone on American Idol worth listening too LFMAO
