The "Emoluments" happened before January 20th by executive order, doesn't matter when she steps down. But this would have effectively given Bush veto power on Obama's appointments and that's not what the clause intended. The courts would see the distinction from it being a executive order from the emoluments being legislated.

This clearly has to do with the fact that yearly pay raises are now common for those positions because of inflation. I guarantee the supreme court would agree. Then again this type of thing even making it to the supreme court would be a waste of tax dollars. The title of this thread immediately gives away your clear bias or lack of understanding. Clinton would be the one breaking the law NOT Obama. The judicial branch is responsible for upholding the constitution in this situation. Rage on. |

He's not "acting as Senator or Representative". He's the "President Elect" and he's only telling us that once he becomes President, he'll be appointing her. As of yet both of them have no official powers.
