I took my neighbor to court - and won
 
Six months ago the guy who owns the house next to came over and asked me to sign this form giving my permission to allow him to build a "sidewalk" from his driveway to the gate of his back yard. I'm a nice guy - sure, no problem.

Suddenly this guy moves in running his landscaping business from his house and he extends his driveway directly to my property line. In the process he took out a tree, and a number of bushes. Now instead of looking out and seeing a nice peaceful scene, I see nothing but concrete and his small fleet of work trucks.

So, I took him to court and bitch smacked his ass down. He was forced to remove some of the concrete to conform with city code. On top of that in it's place he has to plant trees that will prevent me from seeing his damn driveway.

Here's a picture of what it looks like minus the concrete.

The homeowners association also put a lien on the house for parking on the street over night ( he has six trucks for his business ) and for not putting away his garbage. Laugh if you want and poke fun at me, but I paid $500k for my house (it's worth half of that now) and I'm not going to live in the ghetto. He can put his fucking garbage away.

Next up..... We need to talk about his business license (which he doesn't seem to have, at least it's not on his business card) and then we can talk about zoning. Sorry, I don't like being woken up at 6am every morning by his Mexican crew hitching up their trucks and trailers ).

shit man, on my street if you put your garbage cans out too early in the day you can get fined.

I'm about to go to war with my next door neighbor over his noisy teenage kid and his fucking friends and the shit they do when his daddy is working at night. They guy is a local celebrity so the HOA kinda turns their heads about shit... but its just about to get personal when these videocams go up next week.

I have one of those next door. The neighbors son is 18 and he always has a ton of friends over in my front lawn. They threw cigerettr butts in my yard and make noise late into the night. Plus the little douche shoots paintballs all over his walls and mine. Sad thing is, his father is home when he does all of this shit.

I have a nearby neighbour that parks 2 or 3 heavy trucks (often including trailers the same size as the truck) on the nature strip just about every night. I see three trucks go past my place at specific times each morning, I don't know if it's a single person doing a round or there are employees that pick them up.

Anyway, short story is, you're not allowed to park any vehicles on the nature strip. The fact that they're heavy commercial vehicles in a residential neighbourhood is probably a double hit. :2 cents: Time to go "Rochard" on them I think! :D

Does the concept of adverse possession exist where you are? Where a property (or portion of a property) is occupied for long enough without complaint from the rightful owner the occupier has the right to claim it for themselves. Perhaps he was hoping you wouldn't notice he'd extended his project onto your property... for the next decade or so... :D

Glad the judge saw it your way. I take it there's not any zoning about him running the business from his home. Where I live there are only certain types of businesses you can run from your own home. Anything with a certain number of vehicles or even an certain volume of traffic is a no-no. Six landscape trucks would fall into that for sure.

Might even put a call into INS ;)

Course how far do you go when you have to live next to the guy.

Had someone local here with problems like that with the neighbor's teens, partying and tearing stuff up while his parents worked nights.

He talked to the father about it mano to mano... got no where "kids will be kids" and "they don't have people over when we aren't home". Then he spent a couple of nights taping some of the shyt and showed it to the parents. Kids have been totally quiet since then and no extra cars pulling up at night.

Wonder if they're even still alive ..or just locked up in the basement.

The really sucky part is he has three trailers, which he backs into his driveway every day. The corner of the house is all banged up from him backing into the house. What used to be a model house is now a dump.

It all depends on if your in an unicorporated part of your city. Some areas do not require a business license to operate. Just need a tax id. But yeah, he really tried to put one past ya. Good job on sweet revenge.

I'm the loud asshole neighbor where I live, but I've carefully groomed the newer tenants since I've been in our area the longest. No one moves in without warning that I constantly and consistently play loud music and have a lot of people over... A few people have moved with a lil push from me... All the neighbors we have now are great, we all hang out, get loud, but keep a nice respect level for each other. :thumbsup:thumbsup

I completely understand your position and it is totally fair that you addressed the issue as things like that can lower the value of a home. Sucks that the HOA never picked up on it though. You should a write a complaint letter to them and have your fee's waived for a year. hehehe

The amount of litter on our street has tripled since he moved in, and one of the things I constantly see is his business card. Oddly enough it doesn't have a contractor's license number on it, nothing about him being bonded or anything. I'm guessing he's just running this shit out of his house under the radar.

Normally I'd be against that kinda shit suing neighbors but if he's trying to run a fucking lawn service with that many trucks out of a residential neighborhood then he's a ass hole.

My first business was a lawn service that I started at only 16 years old and ran for 10 years. No fucking way in hell would I have tried to run 5 or 6 trucks out of a residential neighborhood. If the guy can afford the house then he can damn sure afford to rent a warehouse somewhere. It's one thing to run a home based business if it affects no one else but that kinda stuff ticks me off in nice neighborhoods.
