A good day for the USA. More of the Patriot Act rulled unconsitutional

Just saw this and thought it was worth posting. A federal appeals court today upheld a ruling that struck down part of the Patriot Act as being unconstitutional. The part struck down prevented anyone who got a national security letter from the government requesting sensitive material from speaking out. This basically meant the government could go to an ISP and request private customer information and records then force the ISP to remain quiet about it. The court found that this forced gag order violated the first amendment.

I personally feel that about 98% of the Patriot Act needs to be tossed out so any victory against it is a good one.

Here is the full story.

If you give up liberty for security....you'll have neither

Not such a good day but a small step in the right direction at least:

Quote:

It remains the case that ISPs served with an NSL are forbidden from speaking out; the difference is that under the ruling it will be somewhat easier for the ISPs to challenge that gag order, and the government will have to do a little bit more to persuade a court to maintain the gag when it is challenged. But despite what the ACLU's press releases imply, this is really not a 'victory' for them, or at least only a very minor one.

It is better than nothing. This is how things like this tend to happen. Rarely is there one big case that removes the entire thing, more likely it is a series of small victories that slowly eats away at it.
