I did.

I shipped a package on the 18th of December. FedEx said it would be there on the 24th but that because of the holiday, there could be a delay...>BUT, if I paid them an extra 8 bucks or so that I could have "Date Certain Delivery."

So, I paid the 8 bucks.

Today is the 28th and the package has still not arrived. It's been sitting in the destination city since the 23rd and has not moved.

I called FedEx to ask for a full refund and was told that "Date certain delivery is not available during the holiday season."

Then I asked why FedEx offered and charged me for a service they to not intend to back up. Why was this service offered if it's not available and how many other people paid for this service only to get screwed by FedEx as well?

I'm not sure how many packages FedEx moves each Christmas but I can assume it's a fairly high number. I think it's also safe to conclude that more people would purchase their "Date Certain Delivery" service during that time of year.

Not sure why they would open themselves up to a class action law suit like that, but they did. :(

Am I off base or is this an unfair business practice on their part?

FedEx has been really slacking lately with stuff. I paid for two day air to get something before xmas and it took four days. when I called to complain they said it is not guaranteed, but i could go to a local office to file for a refund.

i would just dispute the charge. class action will only get the lawyer rich and you $4 of your $8 back

I concur with you. It's only $8, but I sure as hell be pissed if they guaranteed delivery by a certain date and they didn't do it.
Did you pay with a credit card? Then dispute it!
Paid cash? Escalate it with FedEx customer service itself. I'm sure they'll give you your money back if you bitch enough.

I don't care about the 8 bucks. I care a little about the $80+ and then the $8 upgrade for a service they will not stand behind. But what really gets me is the mass scale of those numbers.

Take that 8 bucks and multiply it over how many hundreds of thousands of packages?

How does not not compute into a class action situation?

I had something come via the french version of FedEx [Chronopost]
They're a bunch of fuckers, and never attempt to deliver, they just drop the 'sorry we missed you' slips and fuck off.

Paid for next day delivery, and by chance happened to see the van pull in. The guy hops out, no package in his hand, but a pre-filled 'sorry we missed you' slip.

Ran downstairs, caught him and said: hey, that package was for me - why didn't you call?
He said: Oh, I didn't have your number
I said: It's on the package. So is my door code. And I rang twice to confirm. Why didn't you deliver?
He said: Look man, it's christmas time. Look at all the shit I have to deliver. If I tried to actually deliver it all, I'd get home late.

What a fucking piece of shit.

A refund would be a nice gesture but how about simply admitting that you were wrong and have fucked people out of a shit ton of money during the holidays and when our country is facing economic issues.

I would think you could probably get a full refund if you were able to talk to the right person. I know the 8 bucks isn't a big deal, but obviously you were paying for the package to arrive before xmas and it didn't happen as they guaranteed, so I'd keep bitching for a full refund.

man that reminds me so much of a TV commercial UPS ran some years ago in US.
basically the delivery company was a fly by night european flybynight operation where the final delivery was made by scooter.
the delivery man had the attitude of a french waiter, he could give a shit about your package.. it was actually very funny and sounds like you had a taste of it:1orglaugh:1orglaugh

Sue them. As you said $8 per person multiplied times all the holiday shoppers is a ton of cash.

I didn't ship anything with FedEx but, I had a lot of things shipped to me. Amazingly they were all extra hired help in rented trucks and they actually rang the doorbell and waited for me to answer.

Yes, fucked up that they even charge for this while not being guaranteed!

I do know that all services has seen a huge drop in amount of packages being delievered.
UPS said they delievered 1 million less packages in December than last year.
So, what do they do, they Cut back, they cut the Working people, but keep the 5 managers standing around doing nothing..

Still Not a good way to do business, without a refund of atleast the $8.

My girlfriend was waiting for a gift from me one year and it was super late. The online status showed it as being "on truck for delivery" (or whatever the exact verbage) for several days.

One day she was out and saw a truck so she pulled over where he was parked and confronted the driver who proceeded to tell her "I didnt know where your street was" and gave her the package off the back of the truck.

The moral of the story is that sometimes it's just 1 idiot, not the entire corp. at fault.

I believe the issue is that the drivers are normally subcontacters - they're given X parcels to deliver. Whether it takes them an hour or a day, they're paid the same.

So not delivering them at all, and just leaving slips is a great way around to finishing work at noon.

Couriers generally suck. I sent a package from Toronto to Calgary on the 22nd with Canada Post and it arrived less than 48hrs later.

Thankfully FedEx was fine for me this year. It is UPS that normally fucks my packages up. I ordered some Ipods a year ago and it showed online they were sent. Then it showed it was in the city. After 4 days of waiting for the package I called them. They said the package had disappeared from the warehouse. Damn thief stold the package.

Canada post lost a package that was sent to me from an eBay purchase. The package was missing for almost 2 months. It finally showed up but the box was all jacked up and pieces of the item were sticking out of it.

Canada Post were the biggest cocksuckers I have EVER dealt with as far as shipping goes. The refused to tell me anything except that the package was lost and that they had paid out an insurance claim for it TO THE PERSON WHO SHIPPED IT THAT I HAD ALREADY PAID.

My UPS and FedEx guy both call me whenever they have a package for me. Sometimes I get the slip but a lot of times they just leave the package. I guess I'm lucky.

I don't know if that's true for all of them. My UPS guy has been out delivering packages at 8 p.m. many times before, I was kind of shocked when I heard that. And I am pretty sure both UPS and FedEx have unions.
