Legal Question Regarding Sponsor Content
 
hey,

i've got a free site that i want to make a paysite, Some of the content is videos and pictures from sponsors used to promote the sponsors, is it ok to just turn the site into a paysite and keep the vids and pics used to promote the programs or will the sponsors say i'm using their content for my own content? I dont see why they would say that as I'm Still Promoting them the same way as when the site was a free site but now the content will be in a members area.

any sponsors got an oppinion on this, i dont wanna tread on anyones toes? :)

You should read the Terms of Service of the sponsor program(s) in question, and while it may be obvious I'm going to state that you should contact each sponsor as well.

Random advice here might be interesting and all that, but certainly not specific enough.

Sounds like a great way to get banned from most programs.

As long as you're using the content in question to promote the program to whom the content belongs, I see zero problems with this.

If you splash the sponsor's content on your tour and present it as content a surfer will get access to by joining your paysite, then that would be a problem.

As in most things, common sense prevails here. If you're doing the right thing, the sponsor will have no issues. If you're misleading the surfers in any way, that would be an issue.

Sounds like you're going out of your way to ensure that you're not stepping on anyone's toes and that's a great start....an affiliate every sponsor would like to have.

Follow the TOS of the programs and you have now worries. Some programs allow it, some dont. Do some reading and save yourself some lost money.

Show the sponsors what you're doing. Most of them will have no problem at all.

Like all others said, read the TOS. Also, contact a program rep or program owner before doing this.

To stand any chance of it being allowed, though, it needs to be clear that the content is *primarily* being used to promote the other program.

Not really. It's called an upsell if you do it correctly. Now, if you fill the site up with other people's content and just add a link to their site...then you've crossed the line into stealing.

Or he could just throw it all into a Tube Site, and get AFF and Brazzers / Mofoscash to sponsor it. Almost everyone encourages that, and industry veterans will praise you and link you.
