I didn`t have their content on my site.

I linked to a video hosted on megarotic. The lady was hot and had big tits.

Then they send bitchy notice to ME and not in compliance with DMCA. So they can fuck off. When I asked them to clarify, they insisted that ``they have many lawyers in their intellectual property department`` and that ``their names and contact information are irrelevant``.

I heard that they own some tube site.

I won`t remove the link. Fuck them.

Actually, this was a year ago. The site is still up and doing quite well.

Which video is it?

Just looking at the format of that letter it looks like they are in Canada, Quebec most likely. You pretty much only see " GOVERN YOURSELVES ACCORDINGLY " from French Canada. If you care to push on them a little you for sure can demand an address to write them and you can send a formal response. There's little chance they're going to do anything else but send out emails. They will of course send out emails to everyone who has anything to do with your site, such as hosts, etc... just like the letter says. Email is free and it's easy.

On the other hand, it would be so much easier to just take down the link and then tell them to fuck off, fuck their mom, etc..

um...unless this came as a PHYSICAL certified letter that you had to sign for, it means NOTHING....honestly, the fact they sent it out as an email and no names attached, makes me think they don't even actually have a lawyer and are copying some form letter they found somewhere else

I have been served C&D's before, and my lawyer instructed me that unless they come in the form of a physical letter in your hand that you sign for, they are just blowing smoke and most likely can't afford a real lawyer

a DMCA can be send by email, but the clock don't start ticking unless they confirm they have received it. And that is why your lawyer instructed you not to do anything. What most people then do is send the DMCA to the host, and they often reply.

That letter wasn't too inappropriate but they did a couple things that will cause them to not be taken seriously. If they don't identify themselves and don't leave a way to be contacted that is pathetic. I don't think many people would comply. For one reason its fucking lame, for another you can say you thought it was a prank. Also, giving you 24 hours to clean it up is a fucking joke if its a large tube site. They should have allowed 5 business days.

I do not run a tube site. I run a website where I placed a link to a video hosted on megarotic.com. It was a video of Prya Rai getting fucked. It was the only Brazzers video that I ever linked to. If they hated the video so much, they could e-mail megarotic. Oh wait, they are megarotic's big advertiser...

They're probably asking you to remove the linked video from your site because it is associating their brand with something undesired, or even illegal, like beasty, cp, ra.pe, etc.

If I link to your content in such a way that you don't get proper branding, and/or if I use your bandwidth/hosting to convey that content in such a way that you don't get any benefit from it and my traffic/audience gets all the reward for which they are willing to pay me and not you for the privilege of accessing more content then what would you call that? Maybe not "theft" per se, but does "fraud" work for you?

Bottom line for me though is that in this case Brazzers as owners of the content are asking him not to do what he is doing and he should respect that. It is their content and they can protect and distribute it as they see fit. To tell them in so many words "F-off" makes it seem all the more abusive and a wonton disregard for some elses intellectual property.

In the USA embedding videos on your site that you don't have the right to use is still illegal. I believe there was a case about some guy embeding family guy vids on his site that got in some shit recently. He got in quite a bit of trouble too I think.

Although this is funny if brazzers really does own the tube site so many people say they do...

Content is hotlinked EVERYDAY from gfy, yet none of you come bring ? up then... I am just curious how this differs in any way from gfy and hotlinking content from here?

GFY makes a lot of money, and some would say, a portion of that could in fact be made possible by the amount of copied news articles (drama) and hotlinked images and movies (from the web) often in the form of someone elses created images and definitely someone elses hosting bill...

hopefully you understand my curiosity, as I surely understand your side.

If the variable which makes this a crime is profit, well,... look around.
