EVERYONE INSIDE Your industry is changing fast

Tube sites that pull all the big tube sites videos

I have been seeing more and more sites like http://cliphunter.com/ that are using up the big tubes bandwidth and embedding the big tubes content and or linking to there flvs. I just saw a database here for sale with 250,000 of there videos for you to put into your database and i am wondering how this might change things if at all.

I have a couple questions about this.

1. Is this something that the big tubes can block or would they want to?
2. Could this affect them in a way that they might have to shut down if enough people do this or will it just help them?
3. Is this legal being that the person is not hosting the stolen content and only linking to it?
4. Do you think sites like this could get a lot of traffic because http://cliphunter.com is 1,146 on alexa
5. How will google handle this? do you think they might stop indexing pages with embedded videos because this could litter the search engine.
6. I own http://www.biggestporntube.com which is 100% legal with all the sponsors banners on the videos pages and see it hard to compete. If someone were to build a site like mine and cliphunter put together would the sponsors have a problem with it being that it will steel traffic from the big tubes and bring it back to them even though the big tubes content have stolen shit from sponsors?

1] Yes, it's easy to block. Sites like redtube.com etc do. Do they all want to? Who knows.
2] Depends on the tube. See above.
3] Try hotlinking childporn and see if that defense works ;)
4] Yes?
5] I'll leave this to someone in the know to answer
6] Mixed legal / illegal tubes sites exist. They're called 'illegal' ;)

1. I think your wrong because i see redtubes stuff on these kinds of sites along with those of others. The only real way I know for them to block it is to change there codes which would cause them to lose traffic.

3. But if her not hosting it and a bot pulled it into your site then i think it would be on the person hosting it. But anyways we are not talking about child porn we are talking about the big tubes content.

4. Then my guess is, once more of these sites take the traffic from the big ones like redtube and pornhub the big boys wont be able to pay there bandwidth bill because they will have a lot of bandwidth going through the server but less traffic to there site.
6. I think your wrong because if your not hosting the stuff your not technically steeling it. example: If topbucks or bangbros or some big program found there content on a site like redtube they would send the dmca notice to redtube, the one hosting it that the embedded player is linking to because if they didnt the content would get pulled from the linking site and not redtube and all the others that link to it and stream it.

Robbie 01-23-2009 04:51 PM

Hey Donny, when dmca is sent out it is also sent to the sites linking to it. We have dmca'ed google for instance and had links pulled down.

So if someone who owns that content sees you linking to it...they will ask you to take it down. And if they don't see you linking to it, but rather go straight to the source of the stolen content then you'll have a broken video.

If I were you, yes...I'd use the illegit tubes bandwidth and link up to the paysite who owns the video with your affiliate code. And keep a close eye on that vid to make sure it works.

With as many vids as you have on your tube, it may be a bit difficult to pull that off because you have so many.

well said but sending a dmca notice to everyone linking to it is pointless because as you just said if you get it pulled from the main site stealing it then it doesnt work on anyone elses sites. As far as doing this with my tube I would try it but cant because i am running a nubiles tube script and they will not allow it. Another good question would be though if they sponsors would be mad at a site for doing this to promote there stuff?

Yes, but dmca'ing forums, and sites that link to torrent files on TBP are VERY useful.

As far as whether sponsors are okay with it or not. I would say it would depend upon your relationship with the sponsors in question. If they know you and like you and trust your judgement to send sales...then that would obviously weigh in their decision. If you are unfamiliar with the owner of a program and were worried about ramifications, then I would write them and explain what you are going to do. Of course, at that point they will probably dmca the offending video down that you are hotlinking to.

In the long run you'd be better off hosting vids yourself and staying within guidelines. Tarpy is walking a line over there at cliphunter. So far successfully, but still...it's very gray.

sounds to me like the big tubes can be in some big trouble here soon. I think this thread also explains a little. THEY CANT DO SHIT BY THE COURT OF LAW!
they can bitch, complain, threaten and do whatever they want but at the end of the day people having the balls to stand up to them like this guy below in the link will win. DMCA only applies if your hosting the content and own copyright no? Because if you take a video, picture, article whatever from a site and post it on your site and link to the public free content they are putting out. as long as you put a link to where you got it you are not breaking any laws. Correct me if anyone thinks I am wrong!

I'm not saying anything about gfy...

I'm extremely appreciative that more and more people are out there, like you, trying to educate themselves on the issues... but education often involves a lot of study and very lil talk... Get some more study time put in and you'll be ready for a discussion on DMCA ifs, ands, or buts...

ok instead why dont you try and answer this?
1. Could http://www.cliphunter.com get DMCA notices from redtube pornhub and all the other sites he is embedding?
2. DMCA is pretty much worthless anyways here is why no?
Person buys overseas server put all of brazzers members area on it and brazzers sends out a DMCA to a company that is hosting it overseas and the hosting company replies that they dont need to follow DMCA or maybe doesnt even reply at all, then what?

In your given scenario:

1. Cliphunter could get DMCA from original content owner... whether embedded on your site or hosted local.
2. DMCA is recognized by WIPO, and has been followed up with similar legislature in most areas.

1. yes from the person that owns the content but redtube or pornhub lets say is where he got the embbed video cannot right? because they dont own it!
2.most not all so that was not my question. lets say its in a area where they dont ! then what? something like this already happened if you read http://www.gfy.com/fucking-around-and-business-discussion/883165-brazzers-bitchy-notice-2.html about brazzers sending a DMCA notice to a website hosted in Australia that just had one of there videos on it and the hosting company basiclly told them to fuck off they don't have to follow DMCA

1. Is neither here nor there... Breaking the law is breaking the law... Ask robin hood about that one.
2. Last I checked Australia recognizes WIPO... but there are always variables

Everyone is simply going to have to move to encrypted streaming videos for their sites and then start going after the sites using their current content. It won't be a "fix all" but it sure as well help.

No more downloading content. Your members will get over it.

1. Is this something that the big tubes can block or would they want to?
quantum-x- 1] Yes, it's easy to block. Sites like redtube.com etc do. Do they all want to? Who knows.

--- I had no issues linking to any video on redtube.. Answer: you can try.. but there is always a work around...

<object height="344" width="434"><param name="movie" value="http://embed.redtube.com/player/"><param name="FlashVars" value="id=19403&style=redtube"><embed src="http://embed.redtube.com/player/?id=19403&style=redtube" pluginspage="http://www.adobe.com/shockwave/download/download.cgi?P1_Prod_Version=ShockwaveFlash" type="application/x-shockwave-flash" height="344" width="434"></object>

2. Could this affect them in a way that they might have to shut down if enough people do this or will it just help them?
quantum-x- 2] Depends on the tube. See above.

--- The tubesites can still use flash ads in the player.. also using flash they can still run adds on the sites that are hotlinking (leaching) content.
the hits to the videos also count on their servers so their alexa goes up, seo can go up, and the price of ads goes up...

3. Is this legal being that the person is not hosting the stolen content and only linking to it?
quantum-x- 3] Try hotlinking childporn and see if that defense works ;)

--- True but the content its self(CP) is in question not the Copy rights or the ability to have a searchable data base to locate the content...
If linking was not a legal work around then.. well video.google.com would have issues as would the 1000's of sites hotlinking to full main stream videos...
Google its self for listing in its search results .. torrent link.. mp3's.. DVD rips... the list goes on.. let alone images in image search...
The greater loop hole is when the content is not being policed or being policed in the same manner as google and youtube do.

4. Do you think sites like this could get a lot of traffic because http://cliphunter.com is 1,146 on alexa
quantum-x- 4] Yes?

--- hell ya...

5. How will google handle this? do you think they might stop indexing pages with embedded videos because this could litter the search engine.
quantum-x- 5] I'll leave this to someone in the know to answer

--- depends on if they are using the same text as the site that is being hotlinked from, with some programming you can hide the source location of the flv and google would not know its a hotlink.. IE play the flv being leached in your own flv player.. Currently there are no issues with getting sites that leach indexed quickly...

6. I own http://www.biggestporntube.com which is 100% legal with all the sponsors banners on the videos pages and see it hard to compete. If someone were to build a site like mine and cliphunter put together would the sponsors have a problem with it being that it will steel traffic from the big tubes and bring it back to them even though the big tubes content have stolen shit from sponsors?
quantum-x- 6] Mixed legal / illegal tubes sites exist. They're called 'illegal' ;)

--- If tube leach site and the tube they are leaching from has illegal videos then IMO you are still left with the same base issue the site hosting the content must remove it.. doing so also removes all hotlinks.. So getting stolen content off the illegal tube is still the key.

Something to keep in is that many tube site provide the code needed to hotlink/leach the video on the same page as the video itself..

So someone could place the page in a frame on their page and hotlink your videos..

thats what I thought!!!

leaching the tube illegal content from another tube is 100% legal
as legal as google

PAR 01-24-2009 12:21 AM

exactly..
its as legal as google crawling a site and posting links to mp3, torrent links to stolen content, etc...

You can ask for content to be removed but that's about it. The responsibility is in the hands of the person hosting the content and the content owner.

I mean only offering encrypted streaming in your members area.

We simply need to go back to DRM. If the content goes of the domain it's supposed to be on, it's dead.

Members will cry but they will deal with it. In the long run you will win. :2 cents:
