Open letter to Xbiz World Magazine: Why are you ripping off my graphics?
 

Sitting down to read the March 2009 issue of Xbiz World (the printed magazine), I came across an article on page 88 titled, "ASACP AIDS FCACP IN FIGHTING COMMERCIAL CP" by Stephen Yagielowicz.

Much to my surprise, the example kiddie porn site looks an awful lot like the splash page to one of my sites. See the side-by-side here, I don't have enough posts to embed images: furrygirl.com/share/xbiz.jpg

I don't recall ever seeing another adult web site using that font, and I especially have never seen any web site ever using it on a dark blue splash page in white and light blue text. There is no debating that Xbiz's little example kiddie porn site is based directly on my splash page.

So, Xbiz, what the fuck? What made you pull my URL out of a hat to use as base from which to make a kiddie porn site mockup graphic for your article? I mean, I know I'm young-looking and all that, but I'm also probably the only adult website that specifically forbids affiliates from selling me as a "teen". I have never used the words "teen" or "young" to describe my site, despite the fact I started shooting/webmastering when I was 18. I don't do schoolgirl content, and I go out of my way to avoid portraying myself as super-young, when I could have gone the Little April route if I so wanted.

To see something I've created (even just something as simple as my enter/exit/members buttons and layout) being used as an example of kiddie porn really pisses me off. It would piss off any webmaster.

I would have expected better from Xbiz.

It's not just the font- it's a direct copy of the bottom of my splash page.

I think they different shades of blue and white text? Apparently they have never been used together anywhere before.

Find me one other porn site that uses that font, let alone a porn site that uses that font on a dark blue splash page is that exact same size with the exact same wording. It's not like I used white Verdana text on a black background.

Leave and Enter are obviously not words I hold a patent on. Like I said, I challenge anyone to find any other site with a splash page that uses the exact same font, wording, color scheme, and layout. That's not a random accident.

And the "already a member." She must have the only site like that. What is funny is that she thinks anyone has ever seen her site to rip it off.

The layout is very standard. The only wording that could possibly be copied are Enter and Exit, which again are very standard. White and blue is a pretty standard match, I use it all the time... they even used a different shade than you did. The font... I don't know... maybe it's some top-secret font, I have no idea... but I think you are making a big deal out of nothing.

It also has "already a member? click here" in the same font and placement.

Also look at the "already a member? enter here text"... it's off center a bit in the EXACT same way as in the ad.

I never claimed that I am the only person on the entire planet with leave/enter links on my web site. Keep focusing that red herring, though, and ignore the fact that no one else uses the same fonts and color scheme as what Xbiz ripped off from me. Like I said before, it's not white Verdana text on a black background or anything that is indistinguishable from most adult sites. It's obvious that they took a screen shot of my splash page, cut off the top 2/3s, and added their kiddie porn txt.

Have you thought of starting a search engine? Use a different font for it though.

You're right- I probably am the only person who would notice, but does that make it okay for Xbiz to rip off smaller webmasters because it's easier than ripping off Bang Bus? If someone uploads my copyrighted material to a tube site, is that okay because I'm small? Either copyright infringement and ripping people off is okay, or it isn't. And it's the frosting on a shit cake that my work is being used in the kiddie porn graphic.

Well, they did certainly use a screenshot of your site to make that graphic.

now the question is... who gives a fuck ?

File a DMCA or sue them. Don't talk about it, do it. Contact their host. I am sure they will shut them down immediately.

Furrygirl, do you plan on NOT EVER doing ANY SORT of business with XBiz? Do you have anything against anyone that works at XBiz or was this really about them using the same FONT as you? Honestly?

it would be debatable if it was your own font or you had exclusive rights to it.

Obviously, you've not followed what I said, nor do you understand what the DMCA is. The DIGITAL Millennium Copyright Act isn't about paper-based print magazines printing content they don't own the rights to, so there's no host to contact about a graphic that does not appear online.

I have, however, already emailed an attorney about.

If a big sponsor's web site was being ripped off in the same way, the tone of this thread would be an outpouring of ass-kissing and sympathy for the big sponsor.

this is print work so I'm sure they will come to all our houses and recall all copies cause a font was used that was the same as another site on the small internet
