Court rules against German file-sharing site Finds Rapidshare.com violates copyright

http://www.hollywoodreporter.com/hr/...eafd877858b3a1
"A German state court on Tuesday found file-sharing site Rapidshare.com guilty of violation of German copyright law and set damages at about ?24 million ($34 million)"

And piratebay has a semi-government Dutch organisation suing them:
http://www.thelocal.se/20244/20090624/
If they win, all Dutch ISP's must block their url.
Italy is considering doing something similar.

Excellent.

Thanks for the info.

There is quite a bit of disparity as to whether there is a fine or not. Other sites are reporting - A German court has sided with copyright society GEMA against free file-hosting service Rapidshare, which must now monitor its site to ensure that some 5,000 songs are not posted for distribution on its servers.

"In what could prove a key precedent, the court found Rapidshare, and by extension similar file-sharing sites, bear principle responsibility for ensuring copyright-protected material is not illegally posted on their servers. "

The floodgates may have opened in Germany. France, Italy and Spain are probably going to be next. Once a few big countries get involved and set a precedent, there will be more to follow.

The US has been urging Spain to do the three strikes thing - even though they don't even have it in the US.

Socks 06-24-2009 02:34 PM

I just inquired and if people try to get around an ISP ban using a proxy server, ALL the data you download actually gets passed through the proxy.. It has to download it, then upload it to you.. Twice the bandwidth on their part.. And so there will be no free proxy servers just based on costs.. So then you're looking at huge paid proxy services popping up from hosting companies I imagine.

I'll handle this for him:

<gideongallery>
This judge is an idiot. He will be overturned because of the case of BLAH, BLAH, BLAH VCR's BLAH, BLAH, BLAH
The courts have consistently found that time shifting Yada-yada-yada seeding the cloud in a swarm Yada-yada-yada is the most efficient and best timeshifting device to backup content that you idiots produced and I want to share with a few billion people for free and monetize it for myself using branding bugs under my Fair Use Rights to fuck everybody over and be a thief.
So in closing...let me review: Judge in favor of piracy= Genius, Judge rules against piracy = Idiot, VCR, Branding Bugs, Time Shifting, TimeShifting Devices, Backups, Seeding, Cloud, Swarm, Fair Use
Can't you idiots understand? </gideongallery>

you do realize that my name is a b oardtracker alert
so you just basically called me to this thread

anyway rapidshare makes the file completely available so grokster ruling applys
the transaction they are support always has 1 infringement (sharing) even if the downloading is protected by fair use.

torrents however are different because you don't share a complete file
doesn't mean that the transaction is always non infringing just that it can be.

Taxes in Holland will be lowered soon(!). Do you know why? They found & seized SO MUCH hidden money in offshore countries from Dutch people due to the latest tax treaties and revealing of bank secrets, that too much money is coming in. Go figure.

Looks like the old saying is becoming a reality; "You can run but you cannot hide".

Governments and laws are just starting to catch up with all the online tech stuff and that is going to be a new oppertunity for some and a downfall for others.

I truly hope the honest people will be rewarded in the end. I like happy endings (not just in a Thai massage parlour)

We initially reported that Rapidshare was fined $34 million on the back of this report. This information is wrong, the court only stated that the value of the tracks was estimated at $34 million. The article is updated accordingly and we?re sorry for the confusion.

Hum, hum...
mon frère

like in: Frère Jacques
Are You Sleeping
sang badly by an american guy "la matines..no no! les matines etc

Optional Lyrics:
Frère Jacques, frère Jacques
Montre moi tes couilles.
Ding Dang Dong

and while we are at it.

it's Déjà vu (already seen) not deja vous (not good french and would mean "already you?"...in Africa;0)
Déjà vu is pronounced with a "hard U" not "he english U sounding like the "ou of you"

i just sided with the courts in this ruling and pointed out how torrents were different
by any unbiased point of view that would prove that i don't "always stick up for the pirates"

The question is why do you ignore all the times i say the court is right and claim that i "always stick up for pirates"

The decision is the big thing. It establishes they are breaking laws. with Germany being one of the big guns in Europe expect more EU countries to follow.

The outcome of them being blocked is ess traffic, less advertisers and less profit.

Good idea indeed. Let's do the full tour and all people there in Prague & Brno.

Oh, btw Paul, I spoke to somebody a while ago and he said that you said that nobody had resell rights for your content. Did you forget about our deal when Eva was in the hospital? I just did not had the time yet to put them on our site yet but we do have an agreement and a paid invoice. Just checking if you remember it.

He was wrong. the normal license does not include resale rights. It needs us to re license it to the new buyers.

You got a different license and paid a different price for it. You're fine.

Hit me up when you're coming, will miss Berlin this year. Not making any long term plans until the cancer is beaten and I'm back at work.
