Jay Leno gets his URL from Cyber Squatters!!!
 
Television host Jay Leno has won control of a Web address using the name of his new show.

The U.N.'s World Intellectual Property Organization says current owner Guadalupe Zambrano of Katy, Texas, will have to transfer the domain name -- thejaylenoshow.com -- to the comedian.

The agency says Zambrano failed to demonstrate he had a legitimate reason for registering the address five years ago while Leno was still hosting "The Tonight Show."

Zambrano used the site to redirect Web surfers to his real estate business.

"The Jay Leno Show" premieres Sept. 14 on NBC.

WTF? You need a legitimate reason to register a domain name? I thought it sounded cool, it was available and I thought it would be a good investment - that's about what my "legitimate reasons" for registering a domain name are.

Thats bullshit..If I want to register a domain and its avalable why should I prove a "Legitimate reason" to do it...I have plenty of domain names that I am sitting on...So I say fuck Jay and the U.N.'s World Intellectual Property Organization..

Register all the domains you want. He won it because it's a registered copyright, which is the definition of cybersquatting.

why should you or anyone be allowed to buy a trademarked name? I could see if it was just part of the name like TheJayShow.com and the guys name was Jay but to think you should be able to buy a trademarked name like TheJayLenoShow.com is crazy

this is a slam dunk case - if dude had owned jayleno.com and sent the traffic to his real estate biz the outcome would have been more difficult to predict.

Probably, but I wonder about that sometimes.
I mean, Jay Leno the person built that name.
I don't think I can put the name on a line of clothing and sell it, so why
should I be able to put the name on a website?

Just about anything is trademarked these days, it doesn't give you automatic rights over the domain.

It has to be proven the registrant had prior knowledge of the trademark and registered the domain in bad faith/with intent to profit from the trademark. Clearly this guy was cybersquatting, but in different circumstances the trademark alone wouldn't be enough...

Register anything with a registered trademark and your throwing your money away, because all they gotta do is submit a complaint and show proof of trademark and the domain is theirs. It's that simple.
