i sold a tube domain for $1500 a few months ago forgot to take ot off sedo and just got a 4k offer for the same domain

If you buy MobilePornTube.com, PornTube.com can legally request the domain from you and get it.

I have the shorter iMobileTube.com .....it also has the added value it can be used for mainstream or adult (increases $$$$ ) and could be used for many other subjects if the porn side didnt work out....

PornTube would have to trademark the name MobilePornTube in order to demand the domain. You can't tack on additional words and have the trademark hold. That being said, you could trademark it first if you really wanted to protect yourself.

But as everyone else said, it's all about what you plan to do with it. If you believe the site you plan on building is worth a $3k investment on a domain name then go for it!

hmm .. I think that's Not their trademarked name .. if it's then damn .. there's a big mess .. porntube.com,pornotube.com etc.. and that's not only with "porn" and "tube" but a lot of other trademarks

I can build IAmAPlayBoy.com, and as long as I'm not marketing/designing/offering anything that could confuse a consumer into thinking my site or products are related to or connected to Playboy.com, in any way, there would not be an issue.

Of course, Playboy could file infringement all they want. But, the case is whether the consumer would be confused. if my site was all about me being a playboy in my travels around the world, then there would be no brand confusion, and thus no case.

Obviously this case is hypothetical. I won't be buying and building out that domain. Please don't hurt me, Playboy :)

Right, as long as there is clear differentiation of the products there is no infringing. Or if he bought PornTubeXXX and promoted PornTube, then you are fine there too.

I just want to be clear I'm not saying PornTube is coming after this guy, I don't know if they would even care. I'm just giving a heads up on what has happened in the past and will happen again in the future with similar domain names.

well, chances are he is going to be building a porntube.com like site. just for mobile. yea maybe not the same design. but some sort of video site similar.

Actually, PornTube.com could come after you for using PornTubeXXX. I've had that happen with a certain sponsor over a domain that had their name it. of course, I was pushing their site. Problem was, my serps were far better than theirs.

The problem with porntubexxx.com is aligned with what you said above. The XXX doesn't modify the meaning of the domain words in a significant way. With "playboy", the word can be used in a prior definition, which of course is why Playboy is using it as their brand. With "porntube", there is no prior definition or usage, and it would be a really case to say you were using it in a way non-consistent with a porn tube site :)

We're actually on the same page - just talking about different aspects of it.

And yeah - who knows what the owner of PornTube.com would do.

One reason I probably wouldn't invest in a name with "mobile" tacked on, is that the future will see people building mobile capabilities into their main sites. The word "mobile", et al, will become superfluous. Just extra baggage and entirely unneeded. Except for possibly a pure SE play...

I have the same attitude about .mobi. In a few years, the devices will consume the regular web just fine, with some creative and graceful degradation of full blown browser code to mobile browser compatability.

For instance, my blackberry javelin browses web sites just fine using IE mode. Of course, the text is so freakin' tiny I need reading glasses to use it :)

Yeah, I know some sponsors that are like that. When we first started with TopBucks, we wouldn't register the .net, .org or misspells. We left them for the WMs to register to promote us. Now we register the whole gauntlet for one domain name.

Yes, it will just become extra especially with .mobi increasing in popularity. But for right now until the mobile market gets bigger, you are right that "mobile" in the domain is good for SEO.

I'm not going to pull an Evan or Claire and spam you with similar considerably worse tube names trying to "help". I will say that if you intend to develop the domain, it MIGHT be worth the $3k. Personally, if I were buying to hold and/or sell, I would pay maybe $500 for a name like that at most. $3k is high to me, but I don't develop. The term mobile porn tube does avg 2,900 monthly searches per Google Keyword Tool, and given tube traffic isn't worth much, tapping into that search traffic isn't worth as much either, but it's worth enough to pay some money for it.
