I'm pretty sure you'll need a judgment first. Otherwise they can just tell the collection agency to fuck off and there's nothing they can do about it.

Not necessarily, I was a debt collector once in my life (Shitty job too), and we did collections for a few companies where the debt wasn't much older than a month, with no judgments.

I guess another question. Is this in the US, or in another jurisdiction? Some states have very limited time that you can attempt to collect. Just how old is the debt?

If you're serious about collecting your debt..

you'll need to secure a judgment before the SOL runs out.

SOL is usually based upon where the contract as formed

You can scare them into paying.. but if they told you to fuck off there is nothing you can do about it.
