yep they are, and I guess they end up not having to pay the TV networks for advertising once it gets on the internet so they save $$$ in a round about way

Only if the ad you posted was actually ever banned...or even commissioned by Sprite. Both of which are big fat "NEVER'S"

It's a spec ad...created by an attention whoring marketing company. And picked up by gullible internet users who help virally spread it as "banned" commercials.

The trademark infringement claim is most likely coming from Sprite who never commissioned the commercial.

99% of "banned" television commercials are spec ads :2 cents:
