Nina Fox going to sue affiliates?
 
Just got an email from medium pimpin, whats the deal here?

It recently came to our attention that a certain lawyer representing Nina Fox has been making legal threats towards our affiliates for using Nina Fox content provided by us in our affiliate section.

The content in question was exclusively shot by us and we do have the proper license for it.

However, Nina and her lawyer has still decided to sue us for the use of said content and we simply do not care to fight a legal battle because of two photo shoots.

That being said we will have to ask you to remove any Nina Fox content you have used from our affiliate section.

If you are linking to our FHG's don't worry, they have already been removed but, there was also a free content zip available so if you have used that please pull it.

We're truly sorry for the inconvenience, should you have any question whatsoever please direct them to [email protected] and you shall get a prompt reply.

No she is suing us, we have a three page contract, signed and initialed and her I.D., but with only two sets of content on our site is it worth it to risk it?

It's better to play on the safe side when we are talking one hosted gallery.

To me it's about standing up for yourself..If we let every cum dumpster that decides they don't like the content that they signed away their rights to, scare people into backing down.. What does that say... :2 cents:

I agree its not worth it, but I also hate seeing people strong armed by lawyers when they ar doing nothing wrong.

It's one thing to regret getting content shot, and negotiating a deal to get it offline. But its another to try and stongarm people like this. Don't bite the hand that feeds you

I had a model I shot one time, three sets. She contacted me 2 years later, told me that she was getting out of the business and asked me to stop using her shoots.

I advised her that I would be happy to stop using her sets, provided she purchase the exclusive rights to them. She would get the full copyright to the sets that I had paid her to pose for, and would include the model release that she signed and initialed which gave me unlimited rights to the content, for $1000 per set. (bold type is exactly as I bolded it in the response to her)

Strange, I never heard back from her.

I wasn't saying that as a suggestion to Medium Pimpin, I was just relating an experience. They've got to decide whether it's worth the time and expense to go into a court battle they could easily win, but could result in a tough time recouping legal expenses from the plaintiff. And you can't recoup the time involved.

I was prepared to take that risk and maybe they will, too. But if I were running an affiliate prog of the magnitude they are, I'd be advising affiliates to pull the sets, too. That's just common sense.
