Is it legal to mail porn DVD via USPS?
Is it legal to use USPS service(s) to mail adult dvd?
Or do I have to use FedEx or UPS? |
bump for the same question
|
I don't know for sure, but maybe you can check out some of the online dvd stores and see how they ship.
|
There are states to avoid but why risk it at all? This is how the govt gets you and it maybe a Postal Inspector ordering it.
|
god damn man,go read the ups rules and, or ASK them.....
|
No, IANAL, but the fact interstate distribution was being used was a key in the indictment of John Stagliano in his obscenity case. :2 cents:
Title 18, United States Code, Sections 1466 |
I belive that both UK and USA its an offence to post anything offencive via state postal service.
But I belive its legal via private firms. In the USA its slightly stricker as about a year a go a rimember a girm in the USA posting her used knickers and got arrested. |

Depends on where you are sending it to.
Send it to Germany and it will be sacked by the German customs. |

Fedex. Unless you'd like to end up in jail with Max Hardcore.
|
Don't use USPS. Go with Fedex.
|
all wrong.
1st- the postal inspector is authorized to inspect packages mailed via ANY carrier, usps, ups fedex, ALL of them. do you really believe the postal inspector only has authority over the usps and other carriers have their own inspection? that's simply not true. specifically, you can ship adult material via usps but as the legal code linked to above states- you cannot ship OBSCENE material, and that goes for ALL carriers. USPS specifically states that if you ship unsolicited adult material you must state that on the outside of the packaging. |

you should be far more concerned whether a US Postal Service employee will steal the DVD out of the mail & keep it for himself. UPS & FedEx don't steal from their customers. But the postal service is full of rats who steal their customers mail.
This is what you should worry about. if the feds want to pinch you, it will not happen because of a random mailing of a DVD. They would need to investigate you & put out a sting. So dont worry about getting busted on some random mailer. |
I am pretty sure it is not legal
|
That is a question I would pose to your legal adviser and not depend on answers from a board.
Not trying to be harsh, but really, this is something your attorney needs to address :winkwink: |
I think it depends on the content of the DVDs. Max Hardcore got in trouble for shipping content that was obscene in Florida to Florida. Same with Seymore Butts I think - he shipped obscene material to Alabama and was faced with the possibility of jail time. There are tons of mail based DVD rental companies.
