Woman awarded $2M after dentist pulls 16 teeth

State court records in Florence indicate the jury returned the award late last week.

One of Smith's lawyers, Robert Ransom, said the woman plans to have restorative surgery as soon as possible. That's estimated to cost about $80,000.

Clinic attorney Saunders Bridges said he is considering an appeal.

Not exactly. Firstly, the attorneys will get a large chunk of that. Secondly, the article says the clinic is likely to appeal. Thirdly, after appeals, if any, there's the issue of collecting the judgement.

In this instance, the woman may be in luck, since it's likely the clinic has insurance that will pay some, if not all, of the judgement. But that's not a sure thing... in which case it will come down to court orders to luquidate assets of the business, but can often be a futile effort, if the business declares bankruptcy.

Many of the big monetary awards people hear about are paid by insurance companies of the company sued. If a company being sued doesn't have insurance and/or the insurance refuses to pay, then it's highly likely the plaintiff will get very little, especially after all the attorney fees.

in a civil case, there are 2 different types of damages the jury can award..

1. actual damages - these are the medical expenses, missed income, pain and suffering, legal expenses, etc.... these damages are to compensate the injured party for their financial, physical and mental losses.

2. punitive damages - these damages are for the purpose of punishing the guilty, and the jury can literally pick the amount out of the sky. unlike actual damages, the jury can award you an amount which is higher than the amount that you ask for.

the total award is the combined amount of those damages.

i sat in on a case where a jury awarded over $300,000 to a family because their grandpa got buried in the wrong hole. i can't remember the actual damages of having grandpa dug up and buried in the right hole, but don't think it was very much. $300.,000 was the punitive damages and if i remember correctly, they proved that the funeral parlor deliberately lied about the mistake and that's why it was so high.
