Well they hit him on the distributing child porn charge. If she was 18 and consented to the picture, I am not sure how much of a case they would have. Could still turn out bad for invasion of privacy but with today's 18 year olds taking all these nude pics and sharing them, they have to know they will end up in the wrong hands or the net at some point.

They told the guy they had video of the robbery.

He didn't ask for a lawyer and he didn't ask to see the video. He was offered a plea deal to avoid a trial and turned it down.

At least that's how I read it :winkwink:

I am curious though. . . what were you in court for that they had you in a holding cell with a bunch of felons?

I have to admit I don't know much about how this stuff works. I have only ever gone to traffic court.

I'm not lawyer, but I think they aren't required to turn over every piece of evidence unless there is going to be a trial or unless it is requested by the defense. I don't think they have to tell him "we see your tattoo on the video and know it is you" when they offer him a deal.

If the DA TOLD him that they had him on video, I think it's then up to the accused
to ask to see the video. I don't think the DA is required to carefully explain every
detail of the video to the guy if the dude is too cocky to watch it himself. From my
understanding, each side has to turn over evidence on request - not force the other
side to look at it, and they don't have to explain to the other side why the evidence
is important.
