Acacia Update... fun stuff!

Anyone still remember that name?

Well, for those that do, here is some good news. The Judge has invalidated the remaining patents. That doesn't mean the case is completely over because Acacia has already stated that they plan to appeal, but that is to be expected.

Huge props to all those who fought the good fight. :thumbsup

Quentin 09-29-2009 10:18 AM

That's great news -- even with their intent to appeal. I'm not sure what grounds they will appeal on, but hopefully they won't have any better luck on appeal.

Well done Homegrown and the rest of the defense group!
- Q.

Just Mike 09-29-2009 10:43 AM

Thanks to Homegrown, VS and all the great companies that fought these vermin over the years.

Hope the appeal goes south on them too.

Kenny B! 09-29-2009 10:44 AM

Great news Far-L, now get started on the tubes:-)

Whatever, they cant do shit....their whole structure is based on going after people that do not fight back.

They came after me back in the day, i told them to fuck of and they basically said (ok)

Va2k 09-29-2009 11:45 AM

I want to thank all of those that helped so I can cont with my business! Thanks!

ProG 09-29-2009 11:47 AM

Is anyone still paying licensing to them? I remember a couple companies rolled over pretty quick.

HorseShit 09-29-2009 11:52 AM

I hope they "go away".
Good thing google bought youtube.
Google has good laywers....

Pixelbucks Eric 09-29-2009 12:01 PM

Wow..speaking of a blast from the past :P

crockett 09-29-2009 12:11 PM

What sucks is the people fighting them, have been dishing out lawyers fees for how long now? Now they will have to counter sue, spend even more money in hopes to get their fees back.

I remember when those stupid cocksuckers sent me a letter for a domain I had registered but never put a site on. Those fuck offs were trying to claim they didn't just buy a list of domains somewhere but had their their staff out looking for infringing sites.

LOL I laughed my ass off on the phone with those cock suckers, when I told them the domain they claim was violating their patent was a parked page and had never been anything else. Fucking scaming tools they were.

punker barbie 09-29-2009 12:31 PM

Got a link to a page with the news, or to the judge's ruling?

leedsfan 09-29-2009 12:35 PM

massive props to companies like Homegrown who have been involved in this drama for years pouring money into the case defense fund.

If you have any business to do with these guys or anyone else involved, please consider it!

american pervert 09-29-2009 12:35 PM

I remember the first meeting we had about this at the holio boxing ring in calabasas! glad to see the fight is almost over

XPays 09-29-2009 12:37 PM

Indeed! Everyone involved deserves our applause and appreciation.

Thanks!

Send traffic to programs like HomeGrownVideo and VideoSecrets as well as the other defendants who put in their hard earned money to fight Acacia from stealing it from them

Fight the Patent!!

After Shock Media 09-29-2009 01:59 PM

Only wish I could of sent more to help out.

Perhaps GFY and a few other boards should post a history of this since there have been many newbies since then and even more who did nothing but throw away letters. Then see if you can get some additional money donated to help cover what has to be a huge fucking bill. Maybe some companies could offer up some prizes or something. If not just enough to convience more to send you all traffic. I know I have been sending it affiliate link free since you took this on.

media 09-29-2009 02:01 PM

Nice! Hope that some of the prior art that myself and others also helped in the fight..

pornguy 09-29-2009 02:04 PM

Thank god... I was one of the first to get the letter from them telling me to pay.. I tossed it in the trash and told them to fuck off.

DonovanTrent 09-29-2009 02:33 PM

That's very good news Far-L. I remember getting a BS letter from them and it was AGES ago. It went in the shredder because it was for an unused domain, just like Crockett. Can't believe how long it took.

because just like paysite owners not coming together, content owners did not come together to put money into a pool, hire attorney and target the fledgling tube sites at their inception. paysite owners, affiliates, and credit card processors should ideally have been involved to contribute money as they all make money on the content, and now ultimitately lose on the content theft. everyone is connected.

if they had done so, they could have squashed things, but now, tubes sites have traffic, they have revenue, they have DMCA departments, they are licensing content... genie out of the bottle, train has left the station, the sun is setting.....

and also, tired of all the "fighting" to start up "fight the tubes!" :winkwink:

Fight the cliches!

OY 09-29-2009 03:30 PM

Fantastic!

Best to yourself and Spike for all the hard work!

justsexxx 09-29-2009 03:38 PM

I still remember how epiccash settles and some other ppl as well. Assh*les. Glad someone did fight

Well, the crazy part is they actually asked for the judgement against themselves... which is just bizarre if you ask me... but I guess the intent was to try and get to appeals sooner so they can try it all over again. We will see what happens.

Good ideas there, and although I like them I fear a lot of newer people to the industry might very well just not give a shit.

I remember the day Far-L first posted the initial paypal link for donations, I sent some cash their way about half an hour after it went up, and if there was another donation campain with a link posted I would definitely send some again. I'm sure a lot of us would.

Appeals cost money too, even if you're the one fighting them.

Far-L --

Do appeals courts in the US ever award a final judgement with costs? It would be nice if in the end you guys were awarded a "with costs" judgement and were able to recoup some of what I can only imagine are huge sums of cash used to fight this group of assholes known as Acacia for this long.

Same can be said of the older people who do remember and just shredded the so called "BS letters" or "wiped their asses with it" and never sent a dime.

lazycash 09-29-2009 08:59 PM

Maybe they'll give Pimpdogg his money back.

There are no refunds to people who paid for the license.
This list includes a lot of big companies.

And PS - Hey you one content provider, you know who you are. EAT A SEEPING COCK COVERED IN DICK CHEESE AND SWALLOW THE JUICE.

Would gladly post the name, but you know the damn gfy rules. Fucking hard to prove the matrix of it after so many years, plus we all know that company has plenty of money.

Patent cases are very difficult to win back cash on - wish that was not the case since I am sure people/companies would think twice about trying to push out weak patents if there were a penalty for doing so.

Many thanks for helping out btw... many claimed to help, but very few actually did.

Far-L 09-30-2009 09:46 AM

I should mention that our costs have been extremely low for years due to the fact that mainstream has been involved in fighting the stuff left over after our group led the original charge.

Guess those that licensed still have... what? Like fifteen more years of paying them fees or something like that...

I'm confused, it was PROVEN to be that company, why would that be breaking any rules?
