fuck him... he rolled the dice and lost... he thumbed his nose at the DOJ and they won..

Sirkin is a smart guy. He made some solid arguments. I am disappointed that the 11th Circuit thumbed their collective noses at the Ninth Circuit's decision that a national community obscenity standard should be used for the internet, but thats Florida. For the most part they arent adult friendly.

The decision will be interesting but I doubt he will win -- just a hunch based upon their feelings towards the Ninth Circuit's decision in Killbride.

Lou Sirkin has kept my ass out of jail on numerous occasions. That being said, I don't like his chances in this one...

I don't care if he dresses up that runaway in a shit suit and flushes her down the toilet...does he really deserve to go to jail for that? Have you ever spent a day in jail for working in adult? I have, and I still have arrests I am struggling to have removed from my record...

Despite what I think of him or his porn.
How can you have an 18 year old runaway? Was she mentally incompetent and declared a ward of someone?

Also why the wack at someones age?
Again no comment on his style of porn or consensual abuse - whatever. Adult = adult right? So are we in charge of our own bodies or not and can we or can we not do what we want with them as long as it does not harm someone else? Assuming everyone was of sound mind, then all bets should be off and people should be able to do what they want.

Relentless 10-29-2009 07:32 PM

If you take it as a given that everything alleged is true, he did nothing wrong.

He is accused of having consensual sex with a girl over the age of 18 but acting as if she might be under 18. By that standard we should arrest Robert Deniro immediately for ACTING like he killed someone or Jody Foster and the cast of The Accused for the pinball machine scene...

Iron Fist 10-29-2009 07:46 PM

I mean lets not point to the obvious... why take a chance in a state everyone and their dog KNOWS is not adult friendly. You play with the bull that is Florida, you get the horns.

obviously he does. that's exactly where he is. any fucking idiot knows that you will run into trouble when you combine pushing the boundaries of obscene with mailing it. forgetting the specifics of the legal arguments.. anyone that's not totally retarded knows this was a train wreck waiting to happen.

and when you then run to adult forums to scream "fuck the DOJ" and "fuck the FBI" DURING the investigation - uhmm... yeah... pretty much. you deserve to be in jail. the world will be better for it.

so please... by all means,... start your little terrorist supply store or whatever the fuck, call it "novelties" and then act stupid when your doors get kicked in and everything confiscated and you get charged with 30 federal crimes... then tell everyone involved in the case to get fucked and see if you can use semantics to keep from being bent over and raped 10 times a day.

to me, this isn't about rights. this is about someone that spent his time screaming "fuck the world" in the worst and most offensive way possible... and it came back to bite him in the ass... and he deserved it.

Exactly.... he got jailed because his distributor either (1) made a mistake (2) folded to government pressure and conspired with them.

The guy that actually committed the crime of sending the tape to Tampa is walking around free.

Like Max or hate him .. he was convicted for something he didnt do. No where in the world is that called justice.

Max in a mental case but I like him as my wacked out friend .. We've had good times .. I hope he gets out .. long and short of "obscenity" is that it SHOULD be based on community standards .. and knowing that he should NOT have shipped to a state that hated his content .. this is not a new issue .. we have always watched out about shipping content to states that have issues with whatever content we are shipping .. there are still states that have vibrator laws ... he is the owner of the company and liable for said companies actions ...

who stood up and said "yeah, i love to piss down the throats of crying models and there is nothing you can do about it?" - then put his name on it from start to finish?

when you play with fire - you get burned. end of story.

and again.. the legal semantics are irrelevant. if i was in prison, i would be making these arguments and i understand that.. but when the discussion becomes for everyone else "oh yeah... well he didn't kill her.. he just held her down so the other guy could kill her" its not like my opinion is suddenly going to become "oh, ok... i guess he's innocent, let him go" - my opinion becomes "cool... looks like two fuckers need to fry instead of one"

i completely agree

Redrob 11-01-2009 02:14 AM

Tough case with many angles....

Max is not a nice guy in my book; but, I think he should be able to make his movies and sell them to people who want to buy them as long as the rest of us don't have to be exposed to his depravity without our consent.

As someone once said, "You don't live in a free country if you are not occassionally offended."

montel 11-01-2009 04:03 AM

Do you think Max's cellmate has been using Max's own moves?

Hentaikid 11-01-2009 06:57 AM

I think it's kind of naive to think the people who put Max in jail had any thought for the welfare of his models. That kind of person feels nothing but contempt for porn actresses.

I visited him in the Federal holding facility in downtown LA in early September. He was in good spirits, and was hoping his appeal would be successful. For a guy thrown in jail for doing something he didn't do, his attitude was remarkable.

I really doubt that any of the keyboard warriors in this thread could deal with the Kafkaesque situation Max has found himself in.

you tried to make the point that "justice wasn't served" - my point, which would be fairly obvious to anyone not busy ramping up quota driven, billable hours with questionable items and for any contrived reason,... was that many in Florida would agree that justice was served.

its a subjective concept... hence the need for a judge and jury to make the final decision.... and the opportunities of the prosecution and the accused to argue their case.

and as you well know .. process was followed and he was convicted by a jury of his peers with every opportunity to argue his case. he and his attorneys failed. he was judged.

end of story.

when you play with fire... you get burned. when you push the system and people... eventually the system and people push back. when you position yourself as the worst of worst and scream "fuck you" while you do it... it can only have one outcome. arguing the specifics after the fact is pretty retarded when the risks of his behavior and attitude were quite clear.

we are talking about a guy who happily screamed "fuck you FBI" on this very board while being under investigation and having his office raided... and a guy who pushes the boundaries so far that the vast majority of the people in this business (complete degenerates that the are), are repulsed by his movies. lets not pretend he was just some innocent girl scout, selling cookies door to door, who was snatched up by men in black suburbans, taken to a secret CIA base and wrongly accused of trying to assassinate the president of USA.

what the law should and should not be...

where the boundaries are and should not be...

what people feel is and shouldn't be illegal...

all have nothing to with the fact that this was all an obvious end to a story that wrote its own ending from the start.

Its interesting that you say that since I have a double major in Criminal Justice and Psychology, taught by then current and former FBI agents, and wrote a 180 page thesis on the case studies of 5 serial killers that was read and graded by the former head of the Behavioral Sciences Unit for the FBI at Quantico Virgina. And I can tell you that each serial killer has a different story to tell. You have to look a little beyond the surface to find the truth.

Different story or not.. they all did what they did. if you majored in psychology then you know that first and foremost, they are broken ... and the acts they committed are evidence of that simple incontrovertible fact.

You don't need to look anywhere to know that when someone is out there killing people, their motivation, their personality, their taste in music and whether or not they are charming people, has nothing to do with the fact that they are in fact, serial killers.

... just as i don't need to know how Paul Little feels about his grandma or Britney Spears to know he's a depraved shithead with a fuck you attitude. He did what he did.. and he loved every second of it and he's proud of it.

Good points, but plesurepays has a serious dislike for Max hardcore. Nothing you intelligently point out will make him see anything other than Max did it and he is being punished rightfully for it.

What pleasurepays does not get is that Max is getting punished under a bad ruling due to a very poor interpretation of the obscenity law.

This poor law interpretation and bad ruling has serious consequence for the adult industry down the road, if it is not over turned.

Im cool with Max getting jail time for assault and battery or even rape(if the facts support it). I really dont give a shit what happens to the guy. But i do care when Max gets his civil liberties taken away.

WHY DO I CARE?? Because if his can be taken away, so can mine.

You need to look at this case for the facts and without your personal feelings about Max Hardcore. If you can do that, you will really see what a travesty this case decision really is.:2 cents:

Sebastian ... wow I thought you could have done better. You actually met me. I was on set when you failed as male talent for Billy Watson for Dick Suckers when we were in Vegas at XBiz a couple of years back. Billy is a client.

You might also want to ask Nick, who is listed on New Breed Digital, about me. I have actually given him legal advice.

XPlay is also a client. I was just at Mullen's Halloween party last night.

There is one porn girl that I have been banging for the last 3 1/2 years... my GF Vanessa Blue.

If you really want to know about my cases, feel free to search on XBiz, whom I write a column for as well.

Michael is a pretty stand up guy, i known him for a while and nothing bad has ever been said about the guy. And that is saying a lot for living in porn valley.

2 things i recommend Sabastiansands; Shoot your little birdie in the head and check your facts before you put "shit" up on a public forum. Not cool on a few different levels.
