you know something the rest of us don't?

marketsmart 11-02-2009 06:46 PM

so, i have to ask once again for an actual lawyer to comment..

how can a company, like Redtube, not allow a content owner to upload watermarked videos for free and still adhere to the Safe Harbor act.

If Redtube has the staff to review every video to check for watermarks, and disallow watermarks unless the submitter is paying for submissions, how can that same staff not review content for copyright infringement?

Is it possible for a class action lawsuit against Redtube and other tube sites that follow the same policy?

marketsmart 11-02-2009 06:48 PM

and its Boca Raton not Boca Ratan...

tiger 11-02-2009 06:49 PM

Interesting read.

Lace 11-02-2009 06:54 PM

Oh goodie! More tubes and lawsuits. This should be tons of fun to watch!

Didn't see that one coming. I'm surprised Red Tube would open lawsuit against someone, I would think that would make them more vulnerable to have their identity uncovered.

In a court of law only the specifics of the claims in the lawsuit can be addressed.

"XBIZ was unable to reach RedTube.com officials for comment by post time."

...shocker.

lol trade secrets ? there is no secret to getting "members" to fill up your site with stolen content.

I imagine there are quite a few trade secrets, such as just how profitable they are and exactly who is uploading videos to them :)

so let me get this straight-

WEG opened talks with redtube to buy it, received nda documents revealing tradesecrets.

WEG at ~the same time began buying redtube domain names.

WEG gives private documents to teen revenue, allowing them to sue redtube, based on info from docs

redtube burns $100s of thousands in cash in teenrev lawsuit

redtube files suit against WEG for disclosing nda docs and for cybersquatting?

is that about right?

Very simple, everything they do is illigal and they know it, you are just asking why they dont hide it!!!
Simple, you would need Millions to go after them and as they are based in hong kong you would most likely never stand a chance!
That is how the illigal tubes operate, very simple.

The decission was made to sue before we had the docs and Red Tubes decission to go after Weg may be the wrong one.. :)

SmokeyTheBear 11-05-2009 01:49 PM

I wonder the legality behind an nda if the information disclosed admits an illegal act ?

Like if i offer to sell "joe tacos" , give the potential buyer an nda, then admit i steal all the taco meat from the animal shelter next door, would it be against the nda for the potential buyer to inform the animal shelter that the taco place is stealing from them ?

thx for clearing that up but i am quite surprised to see you admitting that weg gave you nda protected docs.

maybe this isn't pertinent in the litigation?

You need to be able to seperate what is illegal and what is something people on gfy think is naughty. They are two very different things

Choker 11-05-2009 03:15 PM

I'm no attorney but IMO if teenrev had those docs and submitted them as evidence during the trial then the fat lady has sung.
